Legislative Update

2012 is shaping up to be a critical year for the future of online poker. With the Department of Justice’s change in position last December there is a heightened sense of urgency in Washington and there is a greater sense of opportunity across the states. This is good news for poker players who want US-based online poker. But it also underscores growing tensions between a federal and state solution. The PPA has long advocated for a federal bill much like Rep. Joe Barton’s H.R. 2366. This bill would create a competitive market and allow multiple states to share customers, giving players the greatest opportunity to compete in a variety of games and at a variety of stakes. It also will establish a single set of standards rather than a patchwork of state-by-state regulations for online poker.  

We believe the prospects for a federal bill in 2012 are quite good. There is growing bipartisan support on Capitol Hill, and the PPA and others have worked to cultivate a number of external allies such as the traditional gaming companies (MGM, Caesars, Boyd, etc), Indian tribes, law enforcement and those in the banking industry who want a clear set of rules and regulations. Our biggest challenge is the general paralysis of Congress to enact any legislation – not just poker legislation. While this is a big obstacle, we do believe there will be opportunities in the near term to include Internet poker legislation (and in the longer term after the November elections) in larger bills moving through Congress. That is why your voice is so important and we appreciate all you have done to contact your elected officials and remind them that you want a bill THIS YEAR.

While a federal bill is far superior, we cannot ignore the momentum building at the state level. California, Iowa, New Jersey, and Nevada (to name a few) are pushing to get INTRA-state online poker enacted this year. Each of the proposals in those states has their pluses and minuses. The PPA has ramped up its state efforts to ensure that any bill that becomes law puts the players’ interests first. In some cases we have retained local lobbyists to help with state lawmakers and in others we have employed our own grassroots network to advocate for player-friendly bills. Fortunately, we have a strong team of State Directors who are serving as our eyes and ears and helping PPA HQ in Washington monitor these bills.

There is no question that the efforts of the PPA and our active members are paying off. It is hard to believe how much we have changed the perception of lawmakers across the country in just a few years. Let’s not forget that in 2006 the U.S. Congress misguidedly voted to ban Internet poker, and now we are on the precipice of restoring your freedom to play and establishing a safe and regulated market. We will continue to update you on our progress and we hope to have good news to share in the coming weeks and months.

State Director Spotlight — Kansas, Stephanie Harris

Stephanie Harris lives and works in Independence, KS, where she is an avid recreational poker player. She plays regularly with friends and family and she also enjoys playing in charity no-limit Hold’em tournaments in her community. Over the years she has become a staunch advocate for the poker community in Kansas, advocating for the repeal of UIGEA and supporting PPA’s efforts to federally license and regulate online poker. 

As State Director, Stephanie has traveled to Washington, D.C., to help lobby the Kansas Congressional delegation for a federal bill that would license and regulate online poker. She has been instrumental in alerting the national PPA office regarding poker-related legislation at the state level and has led several grassroots activities to raise awareness in the state. 

Stephanie has served as the Kansas State Director for just over a year and is always looking for poker activists to volunteer to help spread the word about the PPA. To reach Stephanie you can email her at [email protected].

The reason we are in this horrid position is not because of the players who sign the petitions, tweet, post, call, write and email. It is because of the ones who don’t. Where are those millions?

My friend, forum poster RiverAnAce, has it right. There is a lot of lobbying going on right now on Capitol Hill. We have a terrific opportunity to enhance the effectiveness of those efforts by telling lawmakers that the American people demand the right to play licensed online poker in their own homes on their own computers!

Last week, I asked you to sign a pro-poker online petition to Senate Majority Leader Harry Reid, Senate Minority Leader Mitch McConnell, Senate Minority Whip Jon Kyl, Speaker of the House John Boehner, and House Majority Leader Eric Cantor. We had a great week, getting almost 5,000 signatures. I thank everyone who signed it.

I believe we can do even more. Will you help out? If you signed already, will you ask your friends and family to sign individually? Will you ask your spouse/significant other to sign individually as well? And, if you did not yet sign it, will you please sign now without delay?

The Change.org Terms of Service allow them to provide our names to recipients. Why is that?

Change.org is a big, well regarded petition site. The term of use and the privacy policy are a bit atypical, mainly because – by definition – they provide our names to the recipients. After all, it is a petition. Still, all they will provide is what you input, which is name, address, and email address. Aside from the email address, you would provide that in any petition you sign, and you would provide your email address in any email to the recipients of the this particular petition. So, there is really no difference in that regard.

I would not ask anyone to do anything I would not do. My wife and I each signed the petition from our personal email accounts. I feel the site T&Cs are fine and had no reservations in signing it at all.

Why partner with Change.org?

PPA has not partnered with Change.org. Change.org is seen on Capitol Hill as large, credible nonpartisan petition site, so it makes sense for us to make use of this free tool. I often use Twitter and Facebook for the Poker Daily Action Plan in a similar manner. Use of those free tools does not constitute a PPA endorsement for those specific sites either, of course.

The Change.org Terms and Conditions specify that data is stored in the U.S. Any idea why?

From my review, it appears simply to be stating that international users are consenting to data they input to be stored on U.S. based servers. I believe this is because EU privacy laws differ from U.S. ones, so the site is making it clear that international users can expect privacy practices to be based on U.S. law and not on EU law.

Didn’t we all sign the Change.gov petition some time ago?

Change.org is a nonpartisan online petition site that is not affiliated with Change.gov. Also, that one was to President Obama. This one is to Sen. Reid, Sen. McConnell, Sen. Kyl, Speaker Boehner and Rep. Cantor.

Will it do any good?

Change.org emails the petition recipients when we sign, helping increase overall effectiveness and ensure we are heard from:       

Think of it this way: what if you started to receive emails from each of your neighbors asking you to mow your lawn more often? Or, what if your company received thousands of emails from valued customers asking you to use a different supplier for your parts? How quickly would you act?

That’s the unique thing about creating an online petition on Change.org: when you specify an email address for your target, each time a supporter signs your petition, an email is automatically sent directly to that person. Governments, companies and individuals value their reputations and feel accountable to their neighbors, constituents and customers. When hundreds or even thousands of emails arrive in their inboxes, the message is very hard to ignore.

Additionally, PPA lobbyists will be able to hand deliver the results.

We are pretty fortunate to live in an era where we have access to great tools like Twitter, Facebook, and online poker forums that we use every day in our advocacy efforts. Now we have Change.org — another free tool we can use to reach out to our elected representatives.

Five years ago, the U.S. House voted to ban online poker by a 3 to 1 margin (a bill that was, fortunately, watered down in the Senate backrooms before becoming UIGEA). Congress is now looking at licensing the game, knowing that if they do not, states will. Even the most strident anti-poker lawmakers are not entertaining the idea of passing legislation to amend the Wire Act to include online poker. It seems quite a lot has come from our efforts as a community, so let’s all keep this going forward!

Won’t online poker come back when those in power decide to let it and not one day sooner?

Our elected representatives will not simply wake up and have an epiphany. It is not as if they will say, “you know…no one has asked for online poker legislation, but let’s go ahead and license it.” They will decide to back us when they feel their constituents want it. Let’s all ensure that they hear from us!

As you know from the past two weekly updates, the PPA is already very active on Facebook and Twitter, but we have exciting news that will help the PPA spread its message. As we continue to highlight the role social media plays in effective grassroots advocacy, we turn our attention to the PPA’s newest form of social media — Google+. 

We are proud to announce the launch of the PPA’s new Google+ page. If you are unfamiliar with Google+, it was launched in September 2011 and has grown at a rapid rate, encompassing over 90 million users. It is widely viewed as Google’s attempt to compete with Facebook. This collection of social products features Stream (a newsfeed), Sparks (a recommendation engine), Hangouts (a video chat service), Circles (a friend management service), Games, and Photos, with more features expected to be added in the near future. For those with questions or want to know how to join Google+ please see Mashable’s “Complete Google+ Guide”. 

Google+ is yet another way for the PPA to spread its message and help supporters in the fight for our right to play. It will allow the PPA to continue to spread up-to-the-minute news, information, and action alerts to our members.

Weekly Update from Rich Muny, VP of Player Relations

Poker enthusiasts continue to be heard on the Hill! There was a lot of mainstream media reporting on the possibility of online poker legislation getting attached to the Payroll Tax bill, showing the extent to which our efforts are bearing fruit. The poker community is now reaching out to the House and Senate Homeland Security Committees to ask for inclusion of online poker into the Cybersecurity Act (which is not a reworked SOPA or PIPA – it is unrelated legislation). It is my hope that poker enthusiasts will contact lawmakers for inclusion of poker every time any legislation that appears to have any shot at passage is introduced

Questions from the Poker Community

I communicate regularly with players on several online forums under my online handle “TheEngineer” and via phone and email. Since taking this role last year, I have received several hundred emails and have responded to all of them. I have received several phone calls and IMs as well. Here are a few that are representative of some concerns over the past month:

Full Tilt Poker, Ultimate Bet, and Absolute Poker still haven’t paid us back. Why should I fight for online poker??

I share your displeasure with the current online poker market. As someone with close to five figures locked up on Full Tilt Poker, I certainly empathize with your situation, as do thousands of our fellow poker players. That’s why we’re trying to fix the problem. The problem is not online poker itself. Rather, the problem is inherent in the current system, as we players do not currently have a mechanism for consumer protection. 

PPA is fighting for licensing, regulation, and consumer protection specifically to address issues like the one we players have now with sites that have yet to repay players in the aftermath of Black Friday. The PPA-supported legislation now in Congress focuses strongly on consumer protection. It directly addresses the problems we have seen with those sites by mandating protected and segregated player accounts, a U.S. presence (to allow for law enforcement action if needed), and other provisions to protect our rights as players. Additionally, licensing authorities will certainly take past behaviors into account when determining the suitability of businesses for gaming licenses. In short, I do not personally believe a site that has not repaid players in full could even hope for a license under these bills. 

I hope this helps address your question regarding information, at least. Thanks again. I wish you well in recovery of your money.

After the worst beat I’ve ever taken, I might change my support of this issue. Kx2 flops, me with KK. Check to a bet and a cool call. turn’s a 2. I bet, get raised, all in from me and a call. River’s a 2 and the guy turns over A2. I might just quit poker.

I’ve been in hands in live games where beats like that happened…that’s just poker. We do not win every hand. Rather, we seek to get the best out of each bet we make and to win in the long run as a result. Legislation won’t outlaw bad beats, but it will provide consumer protections against bad actors. 

As much as I want Internet poker, I won’t support increased government interference via the Cybersecurity Act in order to get it. That is SOPA all over again.

Thank you for sharing your concerns. To be clear, the Cybersecurity Act is not SOPA or PIPA. In fact, it is unrelated (click here for more on the act). That being said, no one is talking about poker players supporting this or any other non-poker bill. The poker community is simply asking lawmakers to attach pro-poker legislation to other bills. Such an attachment would not compel the poker community to support the underlying legislation at all.

We need lawmakers to hear from poker enthusiasts for ALL bills that come forward. Every time any bill gains any steam, they should all hear from us and know that we poker players are demanding our rights.

Update: PPA Board Member Patrick Fleming Testifies at Senate Committee Hearing, PPA at CPAC, and more (02/14/2012)

As we continue to highlight the important aspects of Social Media when it comes to effective grassroots advocacy this February, we turn from one new Internet giant, Facebook, to another tool in the social sphere that is growing at a rapid pace, Twitter. Twitter is very useful to the PPA and our goals. First, it allows us to quickly and easily spread up to the minute information and news to the poker community, which is very active on Twitter. So make sure you follow @ppapoker! Second, like Facebook, a significant number of U.S. Representatives, U.S. Senators, Administration officials and other high-level legislative figures now use Twitter on a regular basis to interact and hear from the average American, like you and I, that they represent. Here is an excellent website that lists all of the members of Congress who are active on Twitter. We encourage you to check it out, interact with them and ask them questions about your right to play poker. You might just get a response, but more than that, we will continue to make sure they know our voices will not be ignored, and we will not go away.  



Weekly Update from Rich Muny, VP of Player Relations

I have great news for everyone. This week was excellent for PPA’s efforts on Capitol Hill.

In our ongoing effort to win supporters from both sides of the aisle, PPA attended the Conservative Political Action Conference in Washington D.C. for the fourth consecutive year. It went very well for us. It’s important that we represent the poker community there and elsewhere within the conservative movement to keep this issue bipartisan. 2004 WSOP Champion & PPA Board Member Greg Raymer, a terrific and tireless ambassador for the game, was on hand to sign autographs and to talk about our issue to attendees. Almost everyone who spoke with us was supportive. A very small number of people did want to debate the tired anti-poker talking points from a half-century ago, but we made short work of that.

PPA conducted many interviews with mainstream and poker media while there. I broadcasted my OnTilt Radio show from the CPAC booth live, did a live interview with QuadJacks from the booth, and did a live wrap-up interview with Short Stacked Radio that evening. 

Raymer and I were interviewed by Xiaoyan Zhang of Voice of America for broadcast in China. Ms. Zhang was very interested in how Americans are able to organize and stand up for their rights against laws they wish to see changed. I am proud that so many poker enthusiasts are standing up for the beliefs in this area. From the interview:




The February 9th Senate Indian Affairs Committee hearing on Internet gaming went very well, too. PPA Board Member & Litigation Support Network Director Patrick “Skallagrim” Fleming testified before the committee, for which he received well-deserved praise on many poker forums for his efforts. Everyone whom we spoke with on Capitol Hill was very impressed with the grassroots social media advocacy of the poker community. It was apparent throughout the hearing that they were well aware of the growing support for online poker across the nation.

Hardly a day goes by when you don’t hear about Facebook. It has had astounding growth as a company, but more impressive is the way it allows users to network and share ideas. The PPA has been on the leading edge of using Facebook for advocacy and each day our efforts are paying off. Just today Arkansas Senator John Boozman addressed Internet poker on his Facebook page due to the overwhelming amount of poker players who have contacted him.  More and more lawmakers turn to Facebook to communicate with the voters and it is important for you to have a presence on this platform.  Today, the PPA has nearly 66,000 Facebook followers who are getting timely news, information and action items from the PPA team.  Please join our Facebook family and encourage your friends to join too. Just one person sharing our page can bring dozens of other people to join the PPA on Facebook and help spread our message.  

We also encourage you to check out the Congress on Facebook page.  This page, created and managed by Facebook, lists every member of Congress on Facebook, and tracks their actions and interactions with others on Facebook.  Check out this fantastic year in review to see just how important Facebook  became in 2011 when it comes to interacting with our lawmakers.  



Weekly Update from Rich Muny, VP of Player Relations

The Senate Indian Affairs Committee is holding a hearing on Internet gaming on Thursday, February 9th at 2 PM ET (more info here), and PPA Board Member & Litigation Support Network Director Patrick “Skallagrim” Fleming will be testifying! I hope you will plan to watch this important hearing.

After the Unlawful Internet Gambling Enforcement Act passed in 2006, Patrick Fleming and I were very active on the poker forums. We were not members of the PPA Board at that time. We were just poker players who were upset that our government sought to strip our rights from us. We came up through the volunteer ranks within PPA together, so I am very gratified to see my friend Patrick representing all of us on Capitol Hill this week!

In other news, as I shared with you here a couple of weeks ago, in our ongoing effort to win supporters from both sides of the aisle, PPA is attending the Conservative Political Action Conference in Washington D.C. This is our fourth consecutive year at CPAC. The conference will be Feb. 9th – 11th in Washington, D.C. at the Marriott Wardman Park.

PPA Executive Director John Pappas, PPA Director of Grassroots and External Affairs Drew Lesofski, PPA Board Member & 2004 WSOP Champion Greg Raymer, and I will all be there. We will have a booth in the exhibition hall. I hope everyone in the D.C. area will drop by to meet us and share your thoughts on the fight for poker!

I hope you have had a chance to read the update you received from PPA yesterday highlighting PC World’s very favorable review of the poker community’s social networking activism. Our efforts were mentioned alongside Arab Spring and other world events of great significance. We poker enthusiasts are clearly having an impact, so will you do your part to keep this up by participating in these poker advocacy efforts?

Grassroots poker advocacy has demonstrated to your elected representatives that there are millions of real people supportive of the pro-poker effort. Our efforts also serve to provide objective evidence to lawmakers that there are not hordes of anti-gaming Americans waiting to pounce on anyone who supports the right to play poker. Lawmakers check their Twitter feeds, Facebook walls, and email inboxes and see not only a lot of pro-poker activity, but little to no anti-poker activity in response. In many cases, this runs directly contrary to the expectations of many elected representatives.

As a result of our momentum, there have been numerous Congressional hearings on the online poker issue. In fact, as I shared last week, the Senate Indian Affairs Committee is holding another hearing to examine the impact of Internet gaming on Thursday, February 9th at 2 PM ET (more info here). Will do your part to support this hearing?

A Pro-Poker Question for President Obama

The White House announced that President Obama will answer questions submitted by the American people at a post-State of the Union interview on January 30th. The deadline to submit questions is January 28th at midnight ET, so let’s all vote up questions in support of licensing online poker now!

To participate, simply go to the White House YouTube page here. Be sure to log into to your YouTube account (or easily create one). Under “About”, enter the word “Poker” into the search field and hit search (see the screenshot below). Look for the video post by PPA Executive Director John Pappas and hit the thumbs up. It’s that easy!

Immediately following this evening’s State of the Union speech, a live panel featuring senior White House advisors answering questions about the President’s speech will be taking questions directly from Twitter. This is a good opportunity for us to tweet pro-poker questions.

I have great news to share with everyone. The Senate Indian Affairs Committee is holding another hearing to examine the impact of Internet gaming, this one entitled “OVERSIGHT HEARING on the U.S. Department of Justice Opinion on Internet Gaming: What’s at Stake for Tribes?” The hearing will be held on Thursday, February 9th at 2 PM ET (more info here). 

These continued hearings are hard evidence of the great work the poker community has been doing to ensure our elected representatives hear from us. I thank everyone for taking the steps necessary to ensure our elected representatives understand that we poker enthusiasts will not back down and will not simply go away!

Poker continues to gain ground on Capitol Hill! On Monday, Gambling Compliance reported some excellent news (click here, subscription required) in an article entitled Reid Says DoJ Opinion Gives Congress Incentive for Internet Poker Bill.

The article quotes Senate Majority Leader Harry Reid (D-NV) as follows: “It [the Department of Justice’s clarification of its interpretation of the scope of the Wire Act as not including online poker] (will) give us an incentive to get something done. We cannot have a series of laws around the country related to [Internet] gaming, I know a lot about gaming. I’m a former chairman of the Nevada [Gaming] Commission, and I think it’s very important that we have a national law.” The article further states that Sen. Reid has confirmed that he is negotiating with Sen. Jon Kyl (R-AZ) on a federal online poker bill bill!

When articles like this goes public, lawmakers always look at public reaction. So, let’s all do our part and tell both that we wish for them to push forward with appropriate online poker legislation! Fortunately, we can do this quickly and easily.

This past weekend, PPA participated in a conference hosted by the National Council of Legislators from Gaming States (NCLGS) to discuss the outlook for licensed Internet poker with state lawmakers, lottery officials, and tribal leaders.

The recent Department of Justice announcement regarding their interpretation of the scope of the Wire Act (please be sure to read the PPA statement on this important decision) has caused some states to start looking at the potential for licensing of intrastate online poker and other forms of Internet gaming. Therefore, it was important for PPA to share with those attending the conference the players’ perspective on the status quo and rationale for supporting a federal bill.

PPA Executive Director John Pappas spoke on a panel with other experts to discuss, “Internet Gambling: Is doing nothing a worst case scenario?”. He discussed how the inability of lawmakers (state or federal) to establish rules of the road for Internet gaming has thus far left consumers vulnerable by preventing appropriate oversight of this multibillion dollar industry. Pappas also explained how proposed federal legislation to regulate online poker will actually enhance states’ gaming rights and not erode them. Unfortunately, it is abundantly clear that the states’ sole interest in perusing licensing is to raise revenue, and that should be a concern for players. Public policy centered on maximizing government revenues will never produce positive outcomes for consumers. While revenue is a natural byproduct of regulation, it should first be about protecting players and giving adults the freedom to engage in a game of skill over the Internet, rather than about maximizing the rake by limiting competition.  

That is why the PPA is a strong supporter of Rep. Barton’s H.R. 2366, the Online Poker Act. H.R. 2366 puts consumers first, while giving states the option of participating in licensed Internet poker.
 
It is important that we continue making our voices heard in our state capitals. We need to continue paving the way so that each governor makes the right decision here. Let’s all tell our governors and state elected representatives that we want the right to play poker in our own homes on our own computers and that we want them to support federal legislation to enable this freedom.
