Last week, I discussed how one can sense the desperation in Venetian / Las Vegas Sands and CEO Sheldon Adelson’s Coalition to Stop Internet Gambling’s all-out approach, as their efforts to date have clearly not produced the groundswell of opposition to online poker that they had hoped. In fact, their efforts have actually aided the push for licensed US poker by giving us a platform. I also mentioned that Adelson will fight harder, reaching out to individual anti-poker lawmakers in an attempt to create an appearance of growing opposition, while simultaneously making state-by-state advocacy more challenging.

We saw some of this a few days ago, when Louisiana Governor Bobby Jindal unfortunately chose to come out against online poker across America. He even suggested that licensed online poker in other states would result in people in his state playing on those sites, this despite the success of geo-located licensed US sites keeping out out-of-state players, thus justifying (in his mind, anyway) Congress shutting down state-licensed sites. Jindal doesn’t mention poker by name, but it is clear from the article that he means poker too. I encourage you to please take a moment to post your thoughts to his anti-poker op-ed here.

Additionally, it is clear that Sheldon Adelson is continuing to seek Congressional supporters for his Internet poker ban bill. Rumors abound that he has found a sponsor in the Senate and is seeking a bipartisan cosponsorship.

What does all this mean? Well, as PPA Executive Director John Pappas and I said last week, it just means PPA and the poker community will continue fighting harder too! Every attack presents incredible opportunities to push our message and to advocate for our cause. All we players and enthusiasts have to do it seize them for maximum gain.

PA Update

Last week, I mentioned that PA State Rep. Mario Scavello had outlined a plan to criminalize online poker in Pennsylvania, calling for jail time for poker players. PA State Rep. Mike Tobash proudly announced his support in his newsletter and Adelson’s coalition immediately released a statement characterizing criminalization of online poker playing as “a step in the right direction.”

Since then, the poker community inundated Rep. Scavello and Rep. Tobash’s Facebook pages with their thoughts on why this is a bad idea. Rep. Scavello, to his credit, apparently gave this serious thought and replied with the following statement:

Good morning all! I believe I have given everyone an equal opportunity to vent…Some have polite some have been down right nasty. I have made my notes. The Pa Senate is in the process of doing a complete study of all types of gaming which includes online gaming.

I will hold off pushing my legislation until the study is complete. If anyone of you would like to stay in touch and communicate in a rational way about this issue send me an e-mail at [email protected] I will leave these posts on for another day…..”

While Reps. Scavello and Tobash have certainly not become poker supporters, this is certainly welcome news for the Pennsylvania poker community.

15 Attorneys General Sent a Letter to Congress; Does Your AG Support or Oppose Your Rights?

On February 4, 2014 fifteen state attorneys general (and the AG from Guam) sent a letter to Congressional leaders calling for a nationwide ban on Internet poker and other Internet gaming. For weeks, the poker community contacted their attorneys general and, as I mentioned in a prior update, 35 of them rejected this letter and the call for an Internet poker prohibition. Several thousand tweets, emails and phone calls were delivered, and it made a difference. Thank you!

PPA has a new webpage with a new tweet to send to your state attorney general. Please take a moment to visit the page and take action. It is important that we thank those who stood with us and remind those who oppose us that we have taken notice. Please take action here!

Lock Poker Issues

As I mentioned in the last update, players have been experiencing difficulties in withdrawing money from Lock Poker for some time. Again, the poker-Black Friday offshore US-facing online poker market has been caveat emptor, so every player choosing such a site needs to be vigilant.

PPA continues to call on Lock Poker to do the right thing and to play its players. I encourage everyone to read the thread on Two Plus Two regarding Lock Poker’s payment problems before making a deposit there.

PPA Twitter Town Hall

On Thursday, February 27th, from 6:30 to 7 PM, PPA will host its first ever Twitter town hall.

This is your chance to ask poker related questions and get a response directly from PPA Executive Director John Pappas. This week in poker started off with Venetian / Las Vegas Sands and CEO Sheldon Adelson’s Coalition to Stop Internet Gambling posting a frenzied, Reefer Madness-esque video attacking online poker and other online gaming with ridiculous hysterics. They even referred to their fellow gaming companies as “disreputable”!


One can sense the desperation in this all-out approach. Their efforts to date have clearly not produced the groundswell of opposition to online poker that they had hoped. In fact, it has actually aided the push for licensed US poker by giving us a platform.

That’s the good news. The bad news is that it just means Adelson will fight harder. In fact, we now see them going after individual anti-gaming lawmakers in an attempt to create an appearance of growing opposition, while simultaneously making state-by-state advocacy tougher.

Just two days ago, we saw a despicable attempt to criminalize playing online poker in Pennsylvania. State Rep. Mario Scavello outlined his plan on Tuesday, calling for jail time for poker players! Adelson’s coalition immediately released a statement characterizing criminalization of online poker playing as “a step in the right direction.” They followed this with, “We call on the Pennsylvania Legislature to vote in favor of this bill and send a powerful message that online gaming has no place in American society.” And, when they say “gaming”, make no mistake – they mean poker too. They have been very clear on that.

This coalition also announced its list of members. While there are some new opponents, it is largely the same faith and family groups who have always opposed us and, for that matter, who are opposed to bricks-and-mortar casinos like the Venetian. This is not the first time Adelson has used a scorched earth policy to try to achieve his aims.

What does all this mean? Well, with Adelson seeing a need to fight harder, it just means PPA and the poker community will continue fighting harder too!

Maryland Update

PPA Director of Grassroots and External Affairs Drew Lesofski, along with PPA activists Neil O’Connor and Akintunde Akinola, testified at the Maryland State House yesterday in support of H.B. 305, a bill that would make it expressly legal to play in and host home poker games in the state.  PPA Executive Director John Pappas testified in support of S.B. 428, the Senate version of H.B. 305. We look forward to continue our fight in changing Maryland’s antiquated home poker law.

Lock Poker Issues

I have very good news to share this week. A new coalition – the Coalition for Consumer and Online Protection – has been formed to help fight the proposed federal ban on Internet poker and other online wagering. This new Washington, D.C.-based coalition, backed by MGM Resorts International and the American Gaming Association with the support of various commercial casinos, equipment manufacturers, Indian tribes and technology companies, is not seeking a specific agenda. Rather, these diverse gaming interests have come together, united around a common goal – defeating Congressional attempts to expand the scope of the Wire Act.

A few years ago, Internet betting opponents tended to focus on online casino-style gaming. Unfortunately, our current opposition is focusing directly on the great game of poker. In this environment, it really makes sense for all stakeholders, especially the poker community, to band together to defeat all efforts to expand the Wire Act.

PPA will, of course, focus solely on poker advocacy and remain neutral on all non-poker wagering. Additionally, we will continue to differentiate poker as a game of skill, as always. What do you think? Please let us know on the PPA Facebook page.


Poker Wins the Attorneys General Letter Fight!

As I shared with you a couple of weeks ago, Las Vegas Sands Corp. / Venetian Casino and its CEO, Sheldon Adelson, asked all fifty state attorneys general to sign a letter that, while cleverly worded to sound as if it merely seeks clarification of the scope of the Wire Act, is actually in support of a bill to ban online poker nationwide. AG letters have been used effectively against us in the past, when 49 signed an anti-online poker prior to UIGEA passing in 2006 and 43 a couple of years later.

I have good news. Just fifteen attorneys general (sixteen including Guam) signed onto this letter, falling far short of the requirement to be adopted as National Association of Attorneys General policy, and even well below that to use NAAG letterhead. While these are sixteen more than we wanted, it represents strong improvement. And, as all fifty were lobbied hard to sign on, it means 35 attorneys general rejected it.

I thank everyone for taking the time to tell their attorney general that we do not want a poker prohibition. We were certainly heard!

Full Tilt Poker Remission Update

Full Tilt Poker Claims Administrator Garden City Group recently started emailing poker players tagged as affiliates the net balances they would be eligible to claim. The net balance was to be their site balance minus their affiliate income. However, the amount these players were provided also deducted all their rakeback. And, there was no formal appeal process.

Once this situation came to light, PPA Executive Director John Pappas immediately gathered up information from member Aaron “WiltOnTilt” Wilt to take to the Justice Department as an example to demonstrate the problem. Aaron had already supplied Garden City Group with information detailing the problem, while also detailing it on OnlinePokerReport.com and Two Plus Two, so it was ready to go. John explained the situation to DoJ. The DoJ agreed and adjusted the procedure to address this issue.

Earlier this week, GCG confirmed this on their website with the following announcement:

INFORMATION REGARDING AFFILIATE BALANCES

Affiliate balances shown upon logging into the online filing site were determined by deducting from the account balance all payments labeled as Affiliate payments in the data provided by Full Tilt Poker. The Department of Justice does not consider rakeback an Affiliate payment and will include rakeback payments in approved remission amounts. However, if rakeback was labeled by Full Tilt Poker as an Affiliate payment on a particular account and was therefore deducted from the balance, it is the player’s responsibility to dispute the account balance and provide an explanation differentiating rakeback from Affiliate revenue.

Maryland Update

PPA Executive Director John Pappas testified at the Maryland State Senate earlier this week on S.B. 428, a bill that would make it expressly legal to play in and host home poker games in the state. There will be further hearings, for a great step toward fixing this antiquated law.

New National Survey Finds Strong Support for Online Poker

A new national survey found that many Americans strongly oppose a nationwide ban on online poker and online casino-style gaming. PPA will, of course, be sharing these results with lawmakers and media. Read all of the findings here.

Ask the White House — About Poker

Today, the Obama Administration will host a day-long social media open house, the Big Block of Cheese Day, during which dozens of White House officials will answers questions from everyday Americans in real-time on Twitter, Facebook, Tumblr, Instagram and via Google+ Hangout.

This is a great way for us to ask the Obama Administration to uphold the Department of Justice’s 2011 opinion that the Wire Act does not apply to online poker.

Full Tilt Poker Remission Coming Soon

Last week, I shared with you new information from Full Tilt Poker Claims Administrator Garden City Group regarding repayment of our Full Tilt Poker balances. Earlier this week, GCG confirmed this on their website with the following announcement:

IMPORTANT NOTICE REGARDING PAYMENT TO PETITIONERS WHO CONFIRMED THEIR FTP ACCOUNT BALANCES

GCG has been informed that the Department of Justice Asset Forfeiture and Money Laundering Section has approved the first round of payments. This distribution will include approximately 30,000 Petitions totaling $82 million submitted by Petitioners with timely, complete Petitions, who confirmed their FTP Account Balances. GCG is currently working with the bank selected by the DOJ to set up the payment process. GCG expects to issue payments via ACH before the end of February 2014 and will post further updates on the payment process in 2-3 weeks.

Please continue to check this website for updates regarding the payment process and this administration.


Kentucky Update

Late last week, I had a terrific meeting with my Congressman, Rep. Thomas Massie (R-KY). We discussed online poker legislation, Sheldon Adelson’s efforts against the game, and other poker-related matters.

I did not have lobbyists or other professionals organize the meeting, nor did I travel to Washington D.C. Rather, I set up the meeting using tools available to all of us. I simply went to Congressman Massie’s website to request the meeting. Our meeting was at a district office, a mere fifteen minutes from my home. All the information needed, including information to leave with lawmakers, is available at the PPA Action Page.

I encourage you to consider setting up a meeting with your congressman, senator, governor using the same tools. With just one afternoon of action, you can make a big difference.

I have great news to share. Yesterday, PPA Executive Director John Pappas spoke with the Asset Forfeiture and Money Laundering Section of the Department of Justice regarding Full Tilt Poker victim remission. He was informed that roughly 30,000 undisputed player petitions totaling $82 million have been approved.

Players with undisputed petitions should be on the lookout for an email with instructions on how to receive payment from claims administrator Garden City Group. The DoJ could not provide John with a definitive date on when these emails will go out or when payments will be processed, but it looks like it will be in advance of their March 31st deadline.

The question of affiliates and red pros remains unresolved for now. The DoJ and Garden City Group report that they are diligently working on this. We expect they will be sharing news with this affected class soon. As they shared in a prior update, there will be a new filing window for those players.

There is still no timeline for disputed petitions. Garden City Group is working on those and hopes more info will be available once the undisputed funds are released. FTP players who have not yet filed a petition can still file; those petitions will be considered.

Anti-Online Poker State Attorneys General Letter

Last week, I shared with you the news that legislation to ban online poker nationwide, the Internet Gambling Control Act, has been drafted and may be introduced in the next few weeks. PPA has since learned that Sands Corp. / Venetian Casino and its CEO, Sheldon Adelson, are asking all fifty state attorneys general to sign a letter that, while cleverly worded to sound as if it merely seeks clarification of the scope of the Wire Act, is actually in support of the ban bill.

Fortunately, many attorneys general have not committed to sign this letter and we want to keep it that way. Attorneys general letters have been used by our opponents in Congressional lobbying in the past, so I encourage everyone to do their part to keep the number of AG signatures to a minimum!

Great News! Maryland House Bill 305 has been introduced by Delegate Kirill Reznik and referred to the Ways and Means Committee. This bill will allow Marylanders to host and play in home poker games.

I have important news to share with you. Legislation to ban online poker nationwide has been drafted any may be introduced in the next few weeks. Click here to view the document.

The “Internet Gambling Control Act” seeks to amend the Wire Act to add online poker and online casino gaming to the list of unlawful games. Needless to say, if introduced it will attract a great deal of negativity. For one, it would shut down licensed online poker sites up and running in three states – New Jersey, Nevada, and Delaware. Those states will not take kindly to an attempted federal shutdown of games they authorized. And, of course, it will draw the intense ire of the poker community.

That being said, there are many online poker opponents in Congress. With tens of millions of dollars in funding for lobbying and public relations from Venetian Resort, Hotel & Casino parent Las Vegas Sands Corp. and its CEO, Sheldon Adelson, and with the online poker fight now moving largely from Congress to the states, we can expect a real push here.

I am strongly encouraging everyone to keep active in letting their lawmakers know that their constituents support poker in all its forms. Can I count on you? Please be sure to do your part by joining and/or renewing your PPA membership for 2014 and participating in the Poker Daily Action Plan.

Social Media Advocacy

Online advocacy through social media is fast becoming one of the most effective ways to deliver messages to politicians. PPA is at the forefront of this strategy and has made it easy for you to participate.

With social media on our side, there is no limit to what we can accomplish. PPA has made it easy for you to contact your lawmakers. We encourage you to do so by participating in the Poker Daily Action Plan, as I mentioned above, and via the PPA app. We also, of course, encourage activism through traditional methods like letters and phone calls to lawmakers as well.

Please follow PPA on Facebook, Twitter, and Google+, and join us in letting your lawmakers know you want them to support your poker rights!

New Hampshire Home Poker Game Update

Good news! On Wednesday, January 8, the New Hampshire full General Court passed pro poker bill H.B. 459, a bill that modernizes New Hampshire’s state gaming laws to explicitly exempt non-commercial home poker games from possible arrest and prosecution.

We could not have done this without New Hampshire State Director Patrick Fleming and we owe him big thanks! The next step is for H.B. 459 to head over to the State Senate, so watch your inbox for future updates and calls to action.

WA State Twitter Town Hall Update

Last Thursday, Washington State House Republican Leadership members Representative Dan Kristiansen and Representative J.T Wilcox hosted the first ever Washington Legislature’s twitter town hall.

We asked poker players in Washington State to participate, and they did so in spades! There were so many tweets about poker that Representatives Kristiansen and Wilcox responded to our concerns by tweeting the below response during their twitter town hall:

The big news this week is the American Gaming Association’s recent escalation of its efforts for online poker legislation. This includes bringing on Jim Messina, President Obama’s 2012 campaign manager, for this push.

I see this as very positive news in our fight. As I have been sharing since the Unlawful Internet Gambling Enforcement Act passed in 2006, the more we advocate for our game, the more we will see others join and expand their efforts here. I encourage you to take a moment to read their press release here.

With this increase in lobbying, we as players and enthusiasts will see the value of our advocacy efforts increase synergistically. Please be sure to do your part by joining and/or renewing your PPA membership for 2014 and participating in the Poker Daily Action Plan.

PPA at PCA

This week, PPA Executive Director John Pappas and Membership and PAC Director Bryan Spadaro attended PokerStars Caribbean Adventure, the largest gathering of poker players outside of the United States.

PokerStars generously sponsored PPA’s visit, including providing us with booth space right outside the tournament room. This allowed John and Bryan to talk with players right at the entrance, updating them on our mission. PPA also hosted – also with the support of PokerStars — a viewing party for the BCS National Championship game. If you watched the game, you know it was an exciting match up. I am pleased to report that the PPA event was a great success. More than 50 players joined PPA, including some of the biggest names in online poker. We even had Jason Alexander of Seinfeld fame come by to show his support.

Most important, John and Bryan were able to discuss current issues facing Internet poker with all of the attendees, building even stronger relationships with leading online players.

Thanks again to PokerStars for inviting PPA to be part of this fantastic poker tournament.

WA Update

Washington House Republicans will host the Legislature’s first-ever Twitter town hall, Thursday, January 9th, from 12:30 p.m. to 1:15 p.m. PT. Participants can ask House Republican leadership members Rep. Dan Kristiansen and Rep. J.T. Wilcox a 140-character question using the hashtag #solutionsWA.

This is a great opportunity to reach out to the House GOP and encourage them to support poker legislation in the days leading up to the legislative session. Our hopes of Rep. Harris introducing a poker regulatory bill this month could be improved by great participation from WA players.

The aftershocks from last week’s House Commerce, Manufacturing, and Trade Subcommittee hearing on online poker and online casino-style gaming continue. There has been a sharp increase in media coverage and overall interest in this issue, which is a terrific way to enter 2014.

U.S. v. DiCristina Update

Efforts also continue on the legal front. Recently, PPA reported that the defense in U.S. v. DiCristina had filed a request to have the case reviewed by the U.S. Supreme Court.

The DiCristina case was the ground breaking case where, after review of exhaustive evidence, a Federal District Court judge found poker to clearly be a game predominantly of skill and ruled that, as a game of skill, it was not covered by a specific federal gambling law (the Illegal Gambling Businesses Act – IGBA).

Sadly, however, this past summer the 2nd Circuit Court of Appeal reversed part of the case and ruled that IGBA did apply to games of skill so long as they are also illegal under state law. The idea that poker games, especially small social poker games such as Mr. DiCristina’s, should be treated the same as illegal lotteries, numbers and craps games is just wrong, and something PPA has fought since its founding. Accordingly, PPA, along with other members of the poker community, have joined Mr. DiCristina in asking the SCOTUS to review the case.

You can find all the briefs supporting the appeal at the PPA website, including one from PPA, another from a group of professional and amateur players, and one from poker historian (and author of Cowboys Full) James McManus. All are good reading for a slow holiday night.

New Jersey Update

Golden Nugget Atlantic City has been given permission by New Jersey casino regulators to begin offering Internet poker (and Internet casino gaming). They will be the seventh of Atlantic City’s twelve casinos to offer Internet poker.

The big news this week is, of course, yesterday’s House Commerce, Manufacturing, and Trade Subcommittee hearing on online poker and online casino-style gaming. The hearing, entitled The State of Online Gaming, “examined the current regulatory landscape for online gaming after the Department of Justice’s reinterpretation of the Wire Act,” with focus on H.R. 2666, Rep. Joe Barton’s (R-TX) Internet Poker Freedom Act.

This hearing was more contested than past hearings on authorizing the game, as Venetian / Las Vegas Sands Corp. and its CEO, Sheldon Adelson, are spending tens of millions of dollars lobbying Congress and states like California and Pennsylvania for prohibitions on online gaming — with online poker firmly in their cross hairs. Representing them at the hearing was Las Vegas Sands Vice President of Government Relations and Community Development Andy Abboud. Joining Abboud in seeking a ban of online gaming was Les Bernal, national director of the anti-gaming group Stop Predatory Gambling.

We were represented by PPA Executive Director John Pappas, who did an outstanding job in making the case for online poker. Joining Pappas in arguing for a federal green light on Internet poker, American Gaming Association President & CEO Geoff Freeman was also very effective in making his case to the subcommittee. Law professor Kurt Eggert and Dr. Rachel Volberg rounded out the invited witnesses.

The hearing featured some lighthearted moments, including Rep. Barton stating that, given the frigid weather, the fact that he arrived to the hearing early after flying in from Dallas-Fort Worth that morning meant that God supported his legislation to license online poker. Countering him on that point was Rep. Marsha Blackburn (R-TN), arguing that the bill number, HR 2666, suggested otherwise. Not to be outdone, subcommittee Chair Lee Terry (R-NE), whose district includes Omaha, Nebraska, suggested that Texas Rep. Barton’s bill needs to ensure that states have the authority to choose which forms of poker would be allowed within their borders, so that they could ban Texas Hold’em and allow only Omaha if they wished.

The hearing focused quite a bit on states’ rights, with considerable discussion devoted to the fact that sites in three states – New Jersey, Nevada, and Delaware — are already up and running. Venetian / Las Vegas Sands’ Andy Abboud tried to walk the fine line of suggesting that bricks-and-mortar casinos are terrific but online poker is so bad for our nation that Congress needs to step in and ban states from allowing it — including even the three states that have already gone forward — by suggesting that “Internet gambling takes gambling too far.”

Abboud’s attempt did not appear to be a very compelling argument early in the hearing, but it then fell apart completely under questioning. Rep. Jan Schakowsky (D-IL) inquired about Venetian’s marketing of Cantor Gaming’s mobile gaming devices, suggesting that it seemed hypocritical. Rep. Barton drove the point home when he displayed a Venetian ad for mobile gaming where one could “wager anywhere in Nevada” and pressed Abboud for an explanation.

Abboud tried to argue that Venetian’s remote gaming is golden while all others need to be banned because Venetian’s remote gaming requires customers to interact with a person at the casino cage and that it takes place in a regulated state. The attempt to answer this fell so flat that Rep. Barton cut him off mid-answer and asked him not to try to filibuster the remaining time.

Next Tuesday, December 10th, the House Commerce, Manufacturing, and Trade Subcommittee (a subcommittee of the House Energy & Commerce Committee) will hold a hearing on online poker and online casino-style gaming. The hearing webcast will be available at http://energycommerce.house.gov.

The hearing, entitled The State of Online Gaming, will “examine the current regulatory landscape for online gaming after the Department of Justice’s reinterpretation of the Wire Act.” The subcommittee will review H.R. 2666, Rep. Joe Barton’s Internet Poker Freedom Act. And, of course, PPA has been invited as a witness.

Unlike some past hearings to license online poker, this one will be hotly contested. As I have been sharing over the past several weeks, Venetian Resort, Hotel & Casino parent Las Vegas Sands Corp. and its CEO, Sheldon Adelson, are lobbying hard for state and federal bans on online poker (and online casino gaming as well). They will be at the hearing in full force, opposing our right to play at every turn. So, needless to say, it’s time to act!
