PPA is returning to the World Series of Poker™ at the Rio Hotel & Casino Friday, July 5th, through Tuesday, July 9th, for the start of the Main Event. Director of Membership & PokerPAC Bryan Spadaro, Member Relations Specialist Dave McGoldrick and I will be on hand at the PPA booth to meet with the poker community regarding the latest in the push for Internet poker legislation, all PPA is doing, and what members can do to support the fight for poker.

I will also be at the PocketFives party at the Gold Coast Bowling Center on July 5th and at the Two Plus Two annual party at South Point Casino, which will feature a free screening of BET RAISE FOLD at 3 pm, on July 6th.

We all hope to meet you this weekend!

Introduction of New Internet Poker Bill Imminent

I have great news. Poker supporter Congressman Joe Barton (R-TX) is introducing a new bill to license and regulate online poker in the U.S. Introduction is expected in the next couple of weeks!

This, along with Congressman Peter King’s HR 2282, the Internet Gambling Regulation, Consumer Protection and Enforcement Act of 2013, ensures we will remain on offense on Capitol Hill. With ongoing efforts by the Venetian/LV Sands Corp. to enact a national ban on online poker, staying on offense on the Hill is key. This should help encourage state legislatures to move forward with their own online poker bills, while also pressuring state-level stakeholders who have not yet come to agreement on a state bill to act.

LV Sands (Venetian/Palazzo) CEO Sheldon Adelson Attacks Online Poker

Las Vegas Sands (Venetian/Palazzo) and its CEO, Sheldon Adelson, have launched a new attack on online poker, seeking a national prohibition. Adelson wrote an op-ed for Forbes advocating for a national ban on online poker & online casino-style gaming, and has been appearing on national television advocating for this since! Most importantly, they are lobbying Congress for this ban.

The response from the poker community was swift. From LV Sands’ Facebook page to the comment sections of mainstream media articles, we have been making ourselves heard. ABC News made note of this in Poker Players, Outraged, Target CEO Adelson Over Internet Gaming Stand.

Las Vegas Review-Journal columnist Howard Stutz wrote a terrific rebuttal to Adelson’s stance, which I encourage you to take a moment to read.

DiCristina Appeal

When Lawrence DiCristina started hosting a friendly poker game in some empty space in a New York warehouse, he probably wasn’t thinking he would become a center of legal attention, but he has. Prosecuted by the federal government under the Illegal Gambling Business Act (IGBA), DiCristina and his attorney turned to PPA for help in presenting his defense.

Aided by PPA’s team of lawyers and experts, DiCristina mounted the first federal challenge to laws that people had long assumed cover poker; he argued that poker is a game of predominantly skill, that IGBA does not specifically enumerate poker as “illegal gambling,” and that IGBA’s definition of “illegal gambling” requires the government to prove the game is a game of chance.

And…he won! In a now-famous 120 page opinion, highly respected Judge Jack B. Weinstein of the Eastern District of New York ruled — after listening to hours and hours of expert testimony — that poker is, in fact, a game predominated by skill and that, as a result, it does NOT fit under IGBA’s definition of illegal gambling. IGBA, you may recall, was also the primary law used by the Department of Justice (DOJ) in the Black Friday prosecutions. The importance of this legal issue is clear.

The DOJ appealed Judge Weinstein’s ruling to the 2nd Circuit Court of Appeals. Interestingly, the DOJ declined to challenge Judge Weinstein’s ruling that poker is a game of predominantly skill. Instead they are only arguing that he interpreted IGBA incorrectly. Nonetheless, the ruling of the 2nd Circuit in this case will no doubt have a significant and lasting effect on the future of legal poker.

The oral argument for the case will take place in NYC TODAY, June 19, and your PPA Litigation Support Director, Patrick “Skallagrim” Fleming, will be in attendance. Oregon Anti-Poker Bill Dies

Earlier this year, Oregon State Representative Julie Parrish introduced H.B.3518, a bill that would have shut down lawful social poker rooms, allowing poker only at events held by charitable, fraternal and religious organizations or at the nine tribal casinos in the state.

Rep. Parrish’s bill failed to gain much traction. Representative Chris Garrett who chairs of the House Rules Committee stated, “I don’t sense any appetite in the Legislature to shut them down.”

Last month, H.B. 3518 had a hearing before the House Rules Committee, where it was discovered the at the majority of support for the bill was coming from casino operators in La Center, Washington, who would rather not have the competition from Oregon card rooms.

The bill is now officially dead. I thank everyone who took a stand against this egregious measure. Be assured that PPA will be closely monitoring the Oregon Legislature for any future anti-poker legislation.

New PPA Pennsylvania State Director

Willard Darling of Luzerne, PA, has been selected as the Pennsylvania state director. In this role, Willard will be responsible for monitoring poker-related issues and events in Pennsylvania, informing the national PPA office of emerging trends or issues, as well as leading PPA activities in the state.

“With more than one million dedicated members, the PPA’s grassroots network continues to be a commanding force, and we are very fortunate to have Willard help lead the unwavering members of Pennsylvania,” said former Senator & PPA Chairman Alfonse D’Amato, chairman. “As a dedicated advocate for safe and regulated poker in the U.S., Willard’s steadfast motivation and passion for the game will strengthen the PPA’s efforts both nationally and at the state level. We are proud to have him as part of our team.”

Willard’s passion for poker originated from his father, who taught him how to play poker as a young man. Willard is an avid player of Omaha and Texas Hold ‘em, his favorite game. Since Black Friday, Willard has frequented the casino poker rooms playing tournaments and cash games, including Texas Hold‘em, Omaha, 7 card stud, 1-2 no limit Hold‘em, and 2-4 limit Hold‘em. He strongly believes poker is a game of skill.

As the Pennsylvania state director, Willard will serve as PPA’s “eyes and ears” and alert members on local news stories or legislation involving poker. He will be responsible for alerting his fellow Pennsylvania PPA members to poker-related events or rallies, recruiting individuals to join the PPA, encouraging members to contact their elected officials on relevant issues, and serving as a spokesperson for local media.

The State Directors program is one component of the PPA’s aggressive campaign to boost member benefits, augment its grassroots efforts and position the organization and its members as a strong voice in national, state and local policy debates. New Online Poker Documentary

BET RAISE FOLD: The Story of Online Poker is a feature documentary that follows a new generation of Internet poker professionals during the meteoric rise and sudden crash of the multibillion dollar online poker industry of the 2000s. The film is produced by Jay Rosenkrantz (Film & Television BA, Boston University ’06), online poker pro and producer of G4TV’s “2 Months 2 Million,” and Taylor Caby, professional online poker player and co-founder and CEO of poker training site CardRunners.

The documentary follows three online poker professionals: a mother working to secure a stable future for her family, a hyper-intelligent player grinding the highest stakes among the poker elite, and a world-traveling pro who now finds his calling in front of a television camera and not just a computer screen. Shot from inside the eye of the storm, BET RAISE FOLD captures how the fallout from “Black Friday” ripped the livelihoods from these players.

The film premiered in Las Vegas at the Palms Casino on June 13th and will be available for streaming on June 30th at www.betraisefoldmovie.com. You can view the movie trailer there as well.

The big news this week, of course, is the introduction of legislation to license Internet poker and Internet casino-style gaming by Congressman Peter King (R-NY). HR 2282, the Internet Gambling Regulation, Consumer Protection and Enforcement Act of 2013, would set up a regulatory framework to foster competition among sites while mandating strong consumer protections. Please take a moment to thank Rep. King on his Facebook page (here) for introducing this bill, and please “like” some of the hundreds of pro-poker comments there.

I am very excited and enthused by this development. For one, this, along with the upcoming introduction of a new poker-only bill by Congressman Joe Barton (R-TX) in the next month or two, ensures we will remain on offense on Capitol Hill. This could also help encourage state legislatures to move forward with their own online poker bills. Another benefit at the state level is that stakeholders who have not yet come to agreement on a state bill will now feel some pressure to act because of pending federal legislation. They may be drawn into coalitions by these continued attempts at Congress to take action.

To be frank, federal legislation is an underdog at this point. As we know, our fight is a tough one. That’s why we players are organized to stand up for our game. Fortunately, there is much we can do to improve our odds. We can all be sure to let lawmakers know to support our right to play. We can also all take part in the Poker Daily Action Plan each and every day! As the rising tide of online poker support will lift all boats, let’s keep creating an environment conducive to action on this important issue.

And lets also remember that the case declaring Poker to be a game of skill is coming up for a hearing before the 2nd Circuit Court of Appeals on 6/19. Our Litigation Support Director Patrick Fleming will be there to report on the proceedings. Look for a full update next week.

DiCristina Poker Case Update

Next week, June 19th, the 2nd Circuit Court of Appeals will hear the DiCristina case. As you remember, last year a federal court ruled in an overwhelming decision that poker is a game of skill. The PPA was active in supporting the case and provided amicus brief and expert testimony that helped lead to the judge’s decision. This case is now on appeal and faces its next big test. Our Litigation Support Director Patrick Fleming will be there to report on the proceedings. Look for a full update next week

As I mentioned last week, PPA had a booth at the World Series of Poker® at the Rio Hotel & Casino last weekend. PPA Director of Grassroots Drew Lesofski and Member Relations Specialist Dave McGoldrick were on hand to meet with the poker community to talk about all PPA is doing and what members can do to support the fight for poker. I’m pleased to report that the weekend was a terrific success! The booth was filled with poker players and enthusiasts. I am very happy that we were able to do this.

PPA will be back at the World Series of Poker for the weekends of 6/21-6/24 and 7/5-7/9 (the opening days of the Main Event). PPA Executive Director John Pappas and I will be there the weekend of 6/21. I will be there the weekend of 7/5 as well. I encourage you to stop by the booth to talk about the latest in the push for poker legislation, to find out what you can do to get more involved, and to renew your membership!

PPA Executive Director John Pappas was in Albany, New York yesterday to meet with lawmakers to discuss opportunities to license and regulate online poker in that state. With a need for revenue and ongoing discussions for expanded gaming in the state, online poker clearly has a place in the discussion.

As I mentioned last week, PPA will be at the World Series of Poker® this weekend to meet with the poker community. We have a booth at the Rio Convention Center this weekend, 6/21-6/24, and 7/5-7/9 (the opening days of the Main Event). I encourage you to stop by the booth to talk about the latest in the push for poker legislation, to find out what you can do to get more involved, and to renew your membership!

East Coast Gaming Congress

Last week, PPA Executive Director John Pappas attended the 17th Annual East Coast Gaming Congress (ECGC). The conference brought together casino CEOs, state lottery directors, gaming regulators, and Internet gaming companies to discuss the ever-expanding gaming marketplace from Ohio to Maine.

PPA was the title sponsor of the conference luncheon entitled, “Anatomy of Successful Legislation.” We were pleased that our New Jersey lobbying allies Princeton Public Affairs Group secured the Honorable John Burzichelli to be the luncheon’s keynote speaker.

The two day conference was packed with informative panel discussions and networking opportunities. John kept the community apprised of conference highlights in real-time through the @ppapoker Twitter account, which I encourage everyone to follow:


The lottery director panel featuring representatives from DC, MD, MA, DE, and GA shed interesting light on the various directions states are looking to take their lotteries online. For example, the Georgia representative wants the lottery to have full online casino gaming and poker in his state, while Maryland is settling for traditional lottery games and is happy to let the state casinos offer other types of Internet gaming. Most of the directors signaled strong opposition to federal bills that would seek to limit their online offerings.

State regulators are facing numerous issues as well. Pennsylvania regulators are grappling with the opening of several new casinos in the Philadelphia area, and Massachusetts is still vetting potential applicants to see who will get licensed for that state’s three new casinos.

New Jersey regulators are welcoming public comment to their new Internet regulations, which will be published next month. They announced the appointment of Mario Galea, an Internet gaming consultant in Malta, to help that state launch online gaming before the end of the year. New Jersey hopes to flip the switch on Internet gaming by November.

The luncheon keynote offered by New Jersey Assemblyman Burzichelli was an enlightening account of how the state’s Internet gaming bill became law. Burzichelli was the lead sponsor of the bill in the Assembly and Raymond Lesniak was the leader in the state Senate. It was gratifying to hear the Assemblyman praise the public (i.e. poker players) for their outcry of support for the bill. He credits the bill success in part to the constituent outreach heard by so many of his colleagues, once again underscoring how grassroots activism can pay off big time in the poker debate!

Oregon Anti-Social Poker Effort Thwarted

On May 15th, Oregon state Representative Julie Parrish’s anti-social poker bill HB 3518 had a hearing in front of the Oregon State House Rules Committee.

This bill would have shut down lawful poker rooms and only allow poker to be played at events held by charitable, fraternal and religious organizations or at the nine tribal casinos in Oregon. Fortunately, in part because of the overwhelming grassroots response by Oregon poker players urging their state representatives to oppose HB 3518, it was tabled without being scheduled for a full vote by the Oregon state House. I thank everyone who took action and ensured the poker community was heard!

Back in 2008, an infamous scandal — the UltimateBet superuser cheating scandal — rocked the poker world. This cheating was uncovered by several diligent Two Plus Two forum posters who observed, documented, and applied statistical analysis to an extensive hand history database. PPA released a statement at that time by our chairman, former Senator Al D’Amato, condemning the scandal (read here).

This weekend, new evidence on the depth of the cheating came to light with the release of two lengthy sound files and a number of screenshots. With this new evidence, PPA again calls for a full investigation by U.S. law enforcement officials into these disgraceful acts and for all perpetrators to be punished both criminally and civilly to the fullest extent of the law. PPA is working with our attorneys to bring full attention of this new evidence to appropriate law enforcement officials.

I am pleased that this new evidence has been made public and call for all remaining undisclosed information to be released immediately. It is by the purifying light of the truth that our game will continue to enjoy a high degree of trust and integrity.

Federal Legislation to License Online Poker Imminent

PPA has learned from Capitol Hill sources that federal legislation to address licensing of Internet poker and Internet casino gaming will be introduced soon — perhaps even before the Congressional Memorial Day recess!

While details of the legislation are still being negotiated, we expect the bill to look similar to legislative efforts put forth by former U.S. Congressman Barney Frank. As in the past, this poker bill will likely be introduced with bipartisan support.

Over the past several months, the fight for online poker has shifted towards the states and we have earned a few victories in those battles. New federal legislation is a result of state activity and a growing concern among Washington lawmakers that a state-by-state approach will leave consumers with a patchwork of laws, rules, and regulations. Undoubtedly, federal lawmakers are also eyeing the ability to raise revenue from online poker. PPA remains fully committed to pushing for legislation on every front: state, federal, and elsewhere. We welcome federal action and look forward to advocating for this in conjunction with current efforts in several states where legislation is pending or being considered. It is my hope that prospects of federal legislation will push state action, while imminent state action will propel the federal bill, resulting in a race to the top.

I will share the information we gather as we learn the details of the final bill.

The first week of licensed online poker in the U.S. has the poker community energized in the push for online poker across our great nation! Many states are now looking into this. This is no longer seen as a theoretical discussion to lawmakers as, now that it is here, it is tangible and “real”. Additionally, many states are desperate for revenue and know that they risk being lost in the shuffle if they do not act fast.

In this environment, it is very important that we as individual players and enthusiasts do our part to tell lawmakers that we demand fair treatment for poker in all its forms – online, card rooms, social games, charity games, etc. Will you make your voice heard by joining your fellow players and enthusiasts in participating in the Poker Daily Action Plan?

Poker Daily Action Plan

I created the Poker Daily Action Plan in 2007, in response to the Unlawful Internet Gambling Enforcement Act. This predates my PPA membership and was initially a humble David vs. Goliath effort. It has been gratifying to see the entire poker advocacy fight grow so strong since that egregious attack on our liberties.

You can participate in the action plan on the Two Plus Two forums (here), the PocketFives forums (here), and various other poker sites (here, sites are listed at item #3). Additionally, I recently started a Facebook site focused exclusively on the action plan, at facebook.com/PokerDailyActionPlan. Will you “like” the page and take actions for our game each day? It takes just a few minutes a day.

Oregon Lawmaker Seeks to Ban Poker Rooms

Last week, I shared with you news that Oregon Rep. Julie Parrish, R-West Linn, introduced Oregon House Bill 3518, a bill to shut down lawful social poker rooms and allow poker only at events held by charitable, fraternal and religious organizations or at the nine tribal casinos in Oregon.

PPA has been working with the card room owners and their state lobbyist in a coordinated effort to stop this misguided bill from becoming law. We understand that there is a good possibility that the Oregon State House Rules Committee will hold a hearing on HB3518 in the near future, so I ask Oregon poker players and enthusiasts to keep an eye on their inboxes for action alerts.

Many poker supporters reached out to Rep. Parrish via Facebook to ask her to reconsider her stance. She initially banned everyone who dared question her stance on poker from her Facebook wall. Then, feeling the heat, she finally relented and posted an odd explanation, where she essentially said it needs to be outlawed because, in her opinion, it’s already illegal (read here…it’s a comment toward the bottom).

Needless to say, that defies logic. If they are illegal, they would be shut down under the laws she claims make them unlawful. Her explanation also fails to answer the question. That is the answer to, “are poker rooms currently unlawful, in your opinion?”, not, “why do you feel poker rooms should be banned?”. Let’s all take a moment to tell her they ought not be banned!

Let’s all tell Oregon state Rep. Julie Parrish to stop her anti-poker crusade, explaining that it is an honorable game that we are proud to play:

North Carolina Charitable Poker Bill Passes Committee Vote

North Carolina PPA State Director Evan Grizzard has informed the national office that State Representatives Jamie Boles, Tim Moffitt and Tom Murry introduced legislation that would allow nonprofit organizations to hold “casino night” fundraisers up to four times a year to help them raise money to support their charitable activities. I am pleased to share the news that this bill, HB 809, was approved by the North Carolina House Commerce Committee by a 27-18 bipartisan vote and is now headed to the House Judiciary Committee!

This is a huge step forward in allowing us to play games of skill like poker in the Tar Heel state!

Vermont Charitable Poker Legislation Effort

Vermont PPA State Director David Sawyer has been working with state lawmakers on introducing pro-charitable gaming legislation there. David has been meeting with local and state elected officials over the past few months and has been building a coalition of opinion leaders to aid its prospects when it is introduced.

PPA at the Global Internet Gaming Summit and Expo 2013 (GiGse)

The Poker Players Alliance once again made the annual trip to San Francisco for the largest and most influential Internet gaming conference in North America! This year, GiGse attracted nearly 700 participants from across the globe. From the largest U.S. gaming companies to small start-up technology firms that specialize in i-gaming software, GiGse was the place to be last week for those with a stake in the future of the U.S. Internet gaming market.

Naturally, PPA took a leadership role throughout the week. PPA Executive Director John Pappas was a featured speaker at the conference.

The week was filled with informative sessions about the future of Internet poker in the United States. GiGse brought together divergent interests like U.S. casinos, state lotteries, Indian tribes, and European online operators to discuss matters like the potential for state and federal legislation, the feasibility of interstate compacts, and the growing interplay between social gaming and real money gaming.

The undisputed highlight of GiGse was the “Licensing Suitability” panel to discuss legal and commercial rationale of excluding off-shore operators. John Pappas, Jan Jones-Blackhurst of Caesars Entertainment, and Mike Rumbolz with Seminole Hard Rock were on this panel.

The discussion was described by some as “lively” and “heated” but, in reality, it was a substantive discussion about who should be eligible to serve U.S. players. Pappas took the position that U.S. gaming regulators, the gold standard for determining the suitability of operators, should maintain their role of examining applicants and issuing licenses to those which meet the suitability requirements. Pappas also added that in the specific case of PokerStars, players from across the country have spoken very clearly that they support that company being part of the U.S. market, either as a direct operator or a partner with an existing U.S. gaming company (tribal, commercial, or lottery). PokerStars’ presence would increase competition, raising the bar for operators to offer consumer-driven products.

The opposing view on the panel was that companies that took U.S. wagers after the enactment of the Unlawful Internet Gambling Act of 2006 (UIGEA) should be completely ineligible to seek licensing or to partner or sell their software to anyone seeking a license. This would strip regulators of their traditional, independent role of determining suitability and would, instead, place this in the hands of politicians.

While many factors should determine whether a company is suitable to operate in the U.S. Internet gaming market, I feel using the enactment of UIGEA as a barrier to entry does not have legal merit. As most educated poker players know, UIGEA did not make any form of gaming illegal. This fact has even been supported by the American Gaming Association in their white paper entitled, Online Gambling Five Years After UIGEA, where they say “Congress has enacted no legislation that squarely addresses the legality of online gambling.”

Further, the Department of Justice opinion from December 2011 and subsequent court rulings such as DiCristina vs. United States, add even greater credence to the legal argument that Internet poker does not directly violate federal law. Given these facts, it is difficult to understand why it is a credible reason to exclude an operator simply because they accepted Internet poker play after UIGEA was enacted, especially if that company has not been found to have violated the law.

Suitability should be about “good character, honesty, integrity and financial suitability.” These factors have been sorted out by gaming regulators for decades and it has worked very well in the brick and mortar environment. It is PPA’s position that regulators should maintain their role to make these determinations and should be able to do so independent of external political or competitive pressures. This will ultimately result in the strongest market for the consumer — an open, competitive market filled with suitable operators to provide us with the best products possible.

Oregon Lawmakers Seek to Ban Poker Rooms

A couple of lawmakers in Oregon are seeking to shut down poker rooms in that state. Rep. Julie Parrish, R-West Linn, introduced Oregon House Bill 3518 to limit poker rooms to religious, charitable, and fraternal organizations. I encourage everyone to read more about this here.
