UIGEAPPA Wins Petition to Delay UIGEA!

On November 27, 2009, the U.S. Department of Treasury and Federal Reserve Board agreed with the PPA’s petition to delay the compliance date for the Unlawful Internet Gambling Enforcement Act (UIGEA) by six months to June 1, 2010. [click here to read the petition announcement]

The extension is an important victory for PPA and our members, who led the fight in advocating for the delay. The ruling affords six months for Congress to revise the act, clarifying the definition of “unlawful Internet gambling” and to start the process to licensing and regulating games of skill like poker.



HR2267 Hearing Congressional Hearing on H.R. 2267

On December 3, 2009, the House Financial Services Committee Chairman Barney Frank (D-MA) held a full committee hearing which attracted seven witnesses, most of whom testified [click here for written submitted testimony] that the best way to protect consumers and families is by licensing and regulating online gaming in the U.S. Critical testimony was delivered by Harvard Professor Malcolm Sparrow and the Executive Director of WiredSafety, the largest and oldest online safety, education, and help group in the world. At the hearing they jointly release the finding of a new study [link to study] which examines the potential risks associated with Internet gaming and show how those risks are successfully avoided though proper regulation and oversight.

The hearing lasted approximately 90 minutes and laid the foundation for a future Committee vote on H.R. 2267, Internet Gambling Regulation, Consumer Protection and Enforcement Act next year after Congress returns from their holiday recess.

S.1597 U.S. Senate Bill S. 1597

S.1597 the Internet Poker and Games of Skill Regulation, Consumer Protection, and Enforcement Act was introduced by Senator Robert Menendez (D-NJ) August of 2009. The legislation establishes the needed licensing and regulatory framework for the United States to protect consumers by exercising appropriate control and oversight over Internet poker and other games of skill. Currently the PPA is working with Senator Menendez who sits on the powerful Senate Finance Committee to add supporters for his bill and raise the profile of our issue in the Senate.

The Fight Continues...

Joe Cada Visits Washington Joe Cada, Winner of the 2009 WSOP Main Event visits Washington

On December 8th, Joe Cada the winner of the 2009 WSOP Main Event visited with several key lawmakers including his home town Congresswoman Candice Miller (R-MI) as well as meeting with both his U.S. Senators, Debbie Stabenow (D-MI) and Carl Levin (D-MI). In addition to meeting his local congressional delegation, Cada had lunch in the Members’ of Congress dining room in the U.S. Capitol Building. Afterwards, Cada was taken onto the floor of the U.S. House of Representatives by Congressman Dean Heller (R-NV-02), a once in a lifetime opportunity. In all, Joe met with more than 10 members of Congress and left a great impression for the poker community.

While in town, Cada visited some of our national monuments and was able to relax a bit by playing in a local weekly $40 buy in home game. To read more click here.

On Thursday December 3, 2009, the House Financial Services Committee will be holding a very important hearing on H.R. 2267, Internet Gambling Regulation, Consumer Protection, and Enforcement Act. If passed into law, H.R. 2267 will allow for licensed and regulated online games of skill such as poker in the United States. In short, it will protect your right to play the game you love online.

This hearing is a very important step in battle to protect poker. For that reason, I am asking you to take a few minutes right now to do three things:

1. Call your member of Congress, [% recip.US_REP({ifEmpty='Representative'}) %], at [% recip.US_REP_CAP_PHONE({ifEmpty='Phone'}) %]  today and tell him/her that:

  • I am a poker player, a constituent and a voter
  • I respectfully request that you attend this very important hearing on H.R. 2267 on December 3, 2009
  • I expect you to support H.R. 2267 to not only protect your right to play poker, but to better protect consumers as well as tap billions of dollars of federal and state revenue currently going uncollected.

2. Email your member of Congress telling them why this bill is important to you and why they need to support H.R. 2267. Feel free to use this sample email to get you started.

3. Tweet your member of Congress. PPA’s Tweet for Poker website makes it easy to contact your representative via Twitter and ask them to support #H.R. 2267 in committee on December 3, 2009.

Taking action today is the most important thing that a dedicated and concerned poker player like you can do to support online poker in the US. The Poker Players Alliance (PPA) can’t do this alone. Please take action today! A successful hearing on Thursday will hopefully lead to a Committee vote in support of poker, so we need your help today!

As recently announced, I have taken on the position as Florida State Director for the Poker Players Alliance. Since Florida is one of the most populous states in the nation and is on the verge of becoming one of the biggest poker destinations as well, there is a vital need for an active PPA membership. Below are the political and legislative issues I see for poker in Florida, and the actions you can take to help.

Uncapped Poker at Florida Cardrooms

This change was tied to the negotiations of a new gambling compact with the Seminole tribe, which has become stalled. However, it is likely that this change for poker, along with other changes in the laws for the pari-mutuels that were part of the same package, will be considered in a either a new separate bill in the next legislative session, or as part of package of gambling expansion at the pari-mutuels in a ballot initiative on next November’s election ballot.

Action Alert:
There is no current action required. I expect the state legislature to proceed on this issue with a positive resolution sometime next year. However, watch for further notice in case we do need to lobby our legislators. You can also keep up-to-date on the latest news on this issue on my 2+2 Forum thread.

Internet Poker State Licensing Program

Last spring a study of online poker activities in Florida was authorized by the state legislature with the intent to develop such a state program. The study is due to be completed by December 1st of this year, and it is possible that new legislation on this issue will be introduced in the spring Florida legislative session.

This licensing legislation will ensure that Internet poker remains available to Florida players despite the upcoming full implementation of the federal Unlawful Internet Gambling Enforcement Act (UIGEA). However, the legislation can two possible tacks: either as an open-access program that allows both in-state cardrooms as well as offshore sites to become licensed for Internet poker in Florida; or as a protectionist intrastate program that only allows in-state cardrooms to offer licensed Internet poker to Florida players. The first option, obviously, is the preferred method for poker players, and would also provide the opportunity for the existing Florida cardrooms to compete in the international Internet poker market. It falls upon the Florida PPA members to safeguard our playing options under the terms of these new laws.

Action Alert:
To prepare for the proactive stance we will likely need to make, I call upon you to help organize and expand the Florida PPA. You can volunteer now to help with some or all of these activities in Florida:
  • Distribute PPA pamphlets to poker players at home games, poker rooms, bar leagues, etc.
  • Meet with state lawmakers to discuss poker issues when necessary.
  • Mobilize your network of players for letter writing campaigns, petitions, etc. when needed.
Federal Licensing Option

The current bills being considered by the U.S. Congress to license and regulate Internet poker at the federal level include an option for each state to opt out of the program. This is a necessary provision on the federal level to preserve states rights. As players, we want to ensure that Florida does not opt out of a federal program.

Action Alert:
It is not too early to let the Florida state legislators know that you do not want Florida to opt out. Send the PPA letters to your lawmakers, and ask your friends, co-workers and family to do the same: http://capwiz.com/pokerplayersalliance/home/

Charity Poker Tournaments

Under current Florida law, poker tournaments held as a fund-raising activity for charitable organizations is unlawful, even when there are no cash prizes and the prizes are donated. This law was framed before the popularity and wide acceptance of poker tournament play and is rather outdated as there is no good reason to prohibit charity poker tournaments today.

Action Alert:
This issue will be taken up sometime in the future. You can let me know now that you will be available for lobbying when the time comes.

Home Game Limits

Florida law allows poker to be played in home games as long as it is a “penny-ante” game, which is defined as a game “in which the winnings of any player in a single round, hand, or game do not exceed $10 in value.” This $10 cap is rather outdated and no doubt makes most home game players into criminals. This cap should be raised to at least $100 for a single hand, and a $50 limit per person for a home game tournament buy-in, which today are reasonable limits for a social home game setting.

This issue will be taken up sometime in the future. You can let me know now that you will be available for lobbying when the time comes.

HR 2267 House Bill

H.R. 2267 the Internet Gambling Regulation, Consumer Protection, & Enforcement Act of 2009 now has 62 cosponsors and is gaining more support each day. In related good news the Congressional Joint Tax Committee, which has the responsibility of assessing the revenue impact of all U.S. legislation, recently reported that licensing and regulation of Internet gaming would produce up to $41,000,000,000.00 (billion!) in revenue over 10 years. This is not a new tax on players, but revenue that could be generated through regulation of the online industry.

Chairman Barney Frank (D-MA) is still committed to holding a hearing and a vote on this bill in his Financial Services Committee. Depending on the schedule this hearing could still happen in 2009.

UIGEA UIGEA Delay Petition

On September 16th the Poker Players Alliance along with the National Thoroughbred Racing Association and the American Greyhound Track Owners Association sent a petition to the US Treasury and Federal Reserve seeking a one year delay of the Unlawful Internet Gambling Enforcement Act (UIGEA) regulatory compliance date. The regulations are currently set for compliance on Dec. 1, 2009, the PPA’s delay would push that till Dec. 1, 2010.

Our petition is getting significant support. More than 50 members of Congress have expressed their support for the delay and several leading banks and financial services trade associations have also expressed serious reservations about the impending compliance date. We are hopeful that Treasury and the Fed will delay the ill-conceived UIGEA and we can spend the next year clarifying this ambiguous law.

State Legislative Update

Randall Castonguay, Massachusetts director of the Poker Players Alliance (PPA) Massachusetts
On Tuesday October 29th, 2009, Randall Castonguay, Massachusetts director of the Poker Players Alliance (PPA), testified before the Massachusetts Joint Committee on Economic Development and Emerging Technologies on the need for licensing and regulation of online poker in the Commonwealth.

Castonguay testified on behalf of more than 25,000 Massachusetts PPA members that any comprehensive gambling expansion should include regulation of online poker. As the head of PPA’s efforts in Massachusetts Castonguay stated, “I have the obligation of not only protecting poker players’ rights, but advancing them.” He described lawmakers’ attempts to criminalize online poker in expanded gambling legislation introduced last session as “blatant hypocrisy.” He noted that such language has been struck from current proposals and outlined the benefits of why criminalization language should not be reintroduced.

California Intra-State Poker California
This summer the heat for Intra-State Internet poker rose to new levels, but it looks like movement this year has sizzled out. With the state’s economic condition worsening, however, it is likely that in the New Year state lawmakers will again review legislation to license and regulate Intra-State Internet poker in California.

In general, the PPA supports state efforts to license Internet poker; however, we are very concerned that the narrowly crafted Intra-State model receiving the most attention will be harmful to Internet players in California. A system that is limited to one or even two operators that are allowed to provide games to CA residents would be a step backwards from the online poker residents enjoy today. Limiting marketplace competition for poker will unnecessarily undermine the player experience by eliminating the incentive for Websites to offer bonuses, rake-back, and other player benefits.

The PPA intends to fully participate in the California debate on regulation of internet poker to make sure the player’s interests are represented.



Florida
As you may know Florida is also exploring the idea of Intra-State Internet poker. On December 1, the results of a legislatively mandated study are due which may make recommendations as to how online poker could potentially be regulated by the State of Florida. We look forward to this study and will post it on our website once it is made publically available. We remain committed that, if regulation is to take place in Florida, it must ensure competition and not monopolies. Rest assured, the Poker Players Alliance will have a seat at the table during legislative discussions and negotiations, protecting Florida player’s rights.

Kentucky Supreme Court Hearing Kentucky Supreme Court Hearing

On Thursday October 22, 2009 the Kentucky Supreme Court heard oral arguments on the Commonwealth’s appeal as part of its ongoing efforts to seize the domain names of 141 internet gaming sites, including several of the leading online poker sites. The right of Kentucky poker player’s was upheld earlier this year when the Kentucky Court of Appeals rejected the Commonwealth’s argument in favor of seizure. The Commonwealth has pursued the case to the state’s highest court.

South Carolina Judge Declares Poker a Game of Skill, Not Chance South Carolina Judge Declares Poker a Game of Skill, Not Chance

In February 2009 a South Carolina judge ruled that poker is a game of skill, but he left it to a higher court to decide if state gambling laws were overly vague. October 2, 2009, a higher court agreed and reversed the convictions of five individuals who had been convicted of illegal gambling in 2006. In addition to holding the law was overly broad and vague; the court embraced the use of the predominance test, citing the overwhelming evidence that skill dominates chance.

But the fight is not over in SC. Just last week, the state Attorney General filed for appeal at the state Supreme Court. The PPA looks forward to our continued successful defense of players rights, even in front of the state’s highest court.
