Back in 2008, an infamous scandal — the UltimateBet superuser cheating scandal — rocked the poker world. This cheating was uncovered by several diligent Two Plus Two forum posters who observed, documented, and applied statistical analysis to an extensive hand history database. PPA released a statement at that time by our chairman, former Senator Al D’Amato, condemning the scandal (read here).

This weekend, new evidence on the depth of the cheating came to light with the release of two lengthy sound files and a number of screenshots. With this new evidence, PPA again calls for a full investigation by U.S. law enforcement officials into these disgraceful acts and for all perpetrators to be punished both criminally and civilly to the fullest extent of the law. PPA is working with our attorneys to bring full attention of this new evidence to appropriate law enforcement officials.

I am pleased that this new evidence has been made public and call for all remaining undisclosed information to be released immediately. It is by the purifying light of the truth that our game will continue to enjoy a high degree of trust and integrity.

Federal Legislation to License Online Poker Imminent

PPA has learned from Capitol Hill sources that federal legislation to address licensing of Internet poker and Internet casino gaming will be introduced soon — perhaps even before the Congressional Memorial Day recess!

While details of the legislation are still being negotiated, we expect the bill to look similar to legislative efforts put forth by former U.S. Congressman Barney Frank. As in the past, this poker bill will likely be introduced with bipartisan support.

Over the past several months, the fight for online poker has shifted towards the states and we have earned a few victories in those battles. New federal legislation is a result of state activity and a growing concern among Washington lawmakers that a state-by-state approach will leave consumers with a patchwork of laws, rules, and regulations. Undoubtedly, federal lawmakers are also eyeing the ability to raise revenue from online poker. PPA remains fully committed to pushing for legislation on every front: state, federal, and elsewhere. We welcome federal action and look forward to advocating for this in conjunction with current efforts in several states where legislation is pending or being considered. It is my hope that prospects of federal legislation will push state action, while imminent state action will propel the federal bill, resulting in a race to the top.

I will share the information we gather as we learn the details of the final bill.

The first week of licensed online poker in the U.S. has the poker community energized in the push for online poker across our great nation! Many states are now looking into this. This is no longer seen as a theoretical discussion to lawmakers as, now that it is here, it is tangible and “real”. Additionally, many states are desperate for revenue and know that they risk being lost in the shuffle if they do not act fast.

In this environment, it is very important that we as individual players and enthusiasts do our part to tell lawmakers that we demand fair treatment for poker in all its forms – online, card rooms, social games, charity games, etc. Will you make your voice heard by joining your fellow players and enthusiasts in participating in the Poker Daily Action Plan?

Poker Daily Action Plan

I created the Poker Daily Action Plan in 2007, in response to the Unlawful Internet Gambling Enforcement Act. This predates my PPA membership and was initially a humble David vs. Goliath effort. It has been gratifying to see the entire poker advocacy fight grow so strong since that egregious attack on our liberties.

You can participate in the action plan on the Two Plus Two forums (here), the PocketFives forums (here), and various other poker sites (here, sites are listed at item #3). Additionally, I recently started a Facebook site focused exclusively on the action plan, at facebook.com/PokerDailyActionPlan. Will you “like” the page and take actions for our game each day? It takes just a few minutes a day.

Oregon Lawmaker Seeks to Ban Poker Rooms

Last week, I shared with you news that Oregon Rep. Julie Parrish, R-West Linn, introduced Oregon House Bill 3518, a bill to shut down lawful social poker rooms and allow poker only at events held by charitable, fraternal and religious organizations or at the nine tribal casinos in Oregon.

PPA has been working with the card room owners and their state lobbyist in a coordinated effort to stop this misguided bill from becoming law. We understand that there is a good possibility that the Oregon State House Rules Committee will hold a hearing on HB3518 in the near future, so I ask Oregon poker players and enthusiasts to keep an eye on their inboxes for action alerts.

Many poker supporters reached out to Rep. Parrish via Facebook to ask her to reconsider her stance. She initially banned everyone who dared question her stance on poker from her Facebook wall. Then, feeling the heat, she finally relented and posted an odd explanation, where she essentially said it needs to be outlawed because, in her opinion, it’s already illegal (read here…it’s a comment toward the bottom).

Needless to say, that defies logic. If they are illegal, they would be shut down under the laws she claims make them unlawful. Her explanation also fails to answer the question. That is the answer to, “are poker rooms currently unlawful, in your opinion?”, not, “why do you feel poker rooms should be banned?”. Let’s all take a moment to tell her they ought not be banned!

Let’s all tell Oregon state Rep. Julie Parrish to stop her anti-poker crusade, explaining that it is an honorable game that we are proud to play:

North Carolina Charitable Poker Bill Passes Committee Vote

North Carolina PPA State Director Evan Grizzard has informed the national office that State Representatives Jamie Boles, Tim Moffitt and Tom Murry introduced legislation that would allow nonprofit organizations to hold “casino night” fundraisers up to four times a year to help them raise money to support their charitable activities. I am pleased to share the news that this bill, HB 809, was approved by the North Carolina House Commerce Committee by a 27-18 bipartisan vote and is now headed to the House Judiciary Committee!

This is a huge step forward in allowing us to play games of skill like poker in the Tar Heel state!

Vermont Charitable Poker Legislation Effort

Vermont PPA State Director David Sawyer has been working with state lawmakers on introducing pro-charitable gaming legislation there. David has been meeting with local and state elected officials over the past few months and has been building a coalition of opinion leaders to aid its prospects when it is introduced.

PPA at the Global Internet Gaming Summit and Expo 2013 (GiGse)

The Poker Players Alliance once again made the annual trip to San Francisco for the largest and most influential Internet gaming conference in North America! This year, GiGse attracted nearly 700 participants from across the globe. From the largest U.S. gaming companies to small start-up technology firms that specialize in i-gaming software, GiGse was the place to be last week for those with a stake in the future of the U.S. Internet gaming market.

Naturally, PPA took a leadership role throughout the week. PPA Executive Director John Pappas was a featured speaker at the conference.

The week was filled with informative sessions about the future of Internet poker in the United States. GiGse brought together divergent interests like U.S. casinos, state lotteries, Indian tribes, and European online operators to discuss matters like the potential for state and federal legislation, the feasibility of interstate compacts, and the growing interplay between social gaming and real money gaming.

The undisputed highlight of GiGse was the “Licensing Suitability” panel to discuss legal and commercial rationale of excluding off-shore operators. John Pappas, Jan Jones-Blackhurst of Caesars Entertainment, and Mike Rumbolz with Seminole Hard Rock were on this panel.

The discussion was described by some as “lively” and “heated” but, in reality, it was a substantive discussion about who should be eligible to serve U.S. players. Pappas took the position that U.S. gaming regulators, the gold standard for determining the suitability of operators, should maintain their role of examining applicants and issuing licenses to those which meet the suitability requirements. Pappas also added that in the specific case of PokerStars, players from across the country have spoken very clearly that they support that company being part of the U.S. market, either as a direct operator or a partner with an existing U.S. gaming company (tribal, commercial, or lottery). PokerStars’ presence would increase competition, raising the bar for operators to offer consumer-driven products.

The opposing view on the panel was that companies that took U.S. wagers after the enactment of the Unlawful Internet Gambling Act of 2006 (UIGEA) should be completely ineligible to seek licensing or to partner or sell their software to anyone seeking a license. This would strip regulators of their traditional, independent role of determining suitability and would, instead, place this in the hands of politicians.

While many factors should determine whether a company is suitable to operate in the U.S. Internet gaming market, I feel using the enactment of UIGEA as a barrier to entry does not have legal merit. As most educated poker players know, UIGEA did not make any form of gaming illegal. This fact has even been supported by the American Gaming Association in their white paper entitled, Online Gambling Five Years After UIGEA, where they say “Congress has enacted no legislation that squarely addresses the legality of online gambling.”

Further, the Department of Justice opinion from December 2011 and subsequent court rulings such as DiCristina vs. United States, add even greater credence to the legal argument that Internet poker does not directly violate federal law. Given these facts, it is difficult to understand why it is a credible reason to exclude an operator simply because they accepted Internet poker play after UIGEA was enacted, especially if that company has not been found to have violated the law.

Suitability should be about “good character, honesty, integrity and financial suitability.” These factors have been sorted out by gaming regulators for decades and it has worked very well in the brick and mortar environment. It is PPA’s position that regulators should maintain their role to make these determinations and should be able to do so independent of external political or competitive pressures. This will ultimately result in the strongest market for the consumer — an open, competitive market filled with suitable operators to provide us with the best products possible.

Oregon Lawmakers Seek to Ban Poker Rooms

A couple of lawmakers in Oregon are seeking to shut down poker rooms in that state. Rep. Julie Parrish, R-West Linn, introduced Oregon House Bill 3518 to limit poker rooms to religious, charitable, and fraternal organizations. I encourage everyone to read more about this here. A major part of PPA’s mission is to organize the poker community in our shared fight for our rights. To this end, PPA Executive Director John Pappas and I traveled to Henderson, NV last week to meet with poker author and owner of Two Plus Two Publishing and Two Plus Two owner Mason Malmuth.

I am pleased to report that we had a terrific, productive meeting. As a great deal of poker grassroots activism is through poker forums like 2+2 – which is just one reason I participate daily on several poker forums and moderate a few, including three subforums on 2+2 – it is important that PPA has strong, transparent, ongoing communication with these sites. Additionally, as Mason is a noted author of several seminal poker books and is a well-regarded leader in the poker community, we are pleased to avail ourselves of all opportunities to meet with him and the staff at 2+2.

As we are good stewards of donations we receive, I am happy to share that I was able to secure a couple of room comps for John and me for the trip, while keeping other expenses to the bare minimum. And, as you can see, we were there to work, sleeves rolled up (for those of us even wearing sleeves, that is):

Online Poker Bill Introduced in Pennsylvania

Great news in Pennsylvania! State Representative Tina Davis has introduced HB 1235 (link), a bill to license and regulate online poker in that state. PPA is in the process of reviewing the bill and will be sending updates and action alerts to our advocates in the state.

Unintended Consequences of New Florida Internet Café Ban

Last week, Florida Governor Rick Scott signed HB155 (link), a bill to ban Internet café gaming, into law. This bill was fast-tracked through the legislative process on the heels of a federal investigation into a charity — Allied Veterans of the World — that authorities say was an illegal gambling front which was able to document having given just 2% of the proceeds to veterans.

The law took effect immediately after the governor signed it, about a month after almost 60 people were arrested in connection with the racketeering investigation into the charity. The investigation and arrests prompted Florida Lieutenant Governor Jennifer Carroll to resign from office over her ties with the group.

Unfortunately, as the law was rushed through with what was described as “dizzying speed,” it has had unintended consequences. Sadly, ClubWPT has pulled out of the Sunshine State as a result. It remains to be seen if others will follow.

Now that these lawmakers have established political cover by rushing this bill through, I expect cooler heads to prevail as we advocate for amendments to this law to permit subscription-type poker sites and, perhaps, even licensed and regulated real money online poker.

I encourage everyone living in Florida to call Governor Scott at (850) 488-7146 to tell him to support poker!

Texas Poker Legislation

The situation in Texas with SJR 64, a proposal that would allow voters and rather than the state legislature to decide if the state should authorize casinos, continues to be fluid. PPA has retained local counsel to complement our advocacy efforts with state lawmakers who are still undecided on how they will vote.

Today marks the second anniversary of Black Friday, the day the major U.S.-facing poker sites were shut down. Here are some terrific thoughts on this from PPA Executive Director John Pappas:



The Fight Since Black Friday

For most, an anniversary means an opportunity to look back on a cherished memory. For the poker community, the anniversary Black Friday is no celebration. Rather, it is a time for reflection and a reason to strengthen our resolve even further.

April 15, 2011 was truly a dark day for Internet poker that reverberated throughout the entire poker world. But, over the succeeding two years, the poker community has been taking back what was snatched away. Just like in poker, success in politics is a skilled art form. By no means has PPA and the poker community done it alone but, in the past year, we have seen three states — NV, DE and NJ — authorize Internet poker. Dozens more have introduced legislation to restore our right to play!

The most significant victory has been in New Jersey, where Republican Governor Chris Christie signed a law that authorizes Internet poker and Internet casino gaming, laying the groundwork for Atlantic City to become a poker mecca. Poker players and enthusiasts took a very active role in getting the bill passed and in persuading the governor to make it law. From personal meetings with the governor’s staff to a bombardment of social networking posts to thousands of calls and emails, poker players and enthusiasts made their voice heard and made signing the bill a very simple choice.

This victory is emblematic of the impact we have had as a community by simply making the effort to let lawmakers know how we feel. I encourage you to take part in the Daily Action Plan (here or here) that Rich Muny puts together. It is simple, fast, and lets you take control of the message to license and regulate poker. Will you take action today?

PPA continues to remain active in New Jersey. Rules and regulations will be released soon and we need to ensure they meet the standards that players expect. We also support the effort by PokerStars to purchase the Atlantic Club casino and invest tens of millions into improving the property. NJ poker players agree this is a worthwhile investment, with 96% supporting the purchase (click here).

New Jersey has proven to be a tipping point for many other states. Now states like Massachusetts, New York, and Pennsylvania are proposing their own laws for Internet poker and Internet casino gaming. California is also in pursuit, with momentum building among leading Indian tribes in that state. And let’s not forget where the fight started in Washington DC and Congress. Longtime poker champion Representative Joe Barton (R-TX) intends to push online poker legislation again this year and is already working to earn the support of powerful allies in Congress. To use a poker phrase, there is a Full House of activity on the legislative front, and PPA is there each step of the way to advocate on your behalf.

Even with the progress that is being made in legislatures, the lingering issue of Full Tilt Poker accounts remains a major concern for the PPA. Thankfully, through the PokerStars-negotiated settlement with the US Government, the company provided funds so the US Department of Justice has the ability to refund the players fully. Even with the recent announcement that a third-party payment administrator has been hired, no one is pleased with the slow progress to reimburse players. We have continued to speak with the DoJ and have provided them with detailed information on the best way to move forward with player refunds. We will continue to monitor their progress, ask for expedited action, and keep affected players fully informed (click here).

While the anniversary of Black Friday is, again, no cause for celebration, I do celebrate the fact that poker players have become so active in the past two years. Each day that we stand up for ourselves and for our game, we become a stronger political force. PPA appreciates that so many of you have made advocating for your rights a priority. I encourage all of you to join with us, so together we can bring Internet poker back to the United States and expand live poker opportunities for players in every state!

Texas Hearing

With all the victories we have seen in 2013, we were recently reminded that opponents of poker have not gone away or given up.

Last week, Kansas Senator Jacob LaTurner led an effort to criminalize playing online poker in his state, proposing a last minute amendment to a broader gaming bill that would have made playing online poker and online casino-style games a class B nonperson misdemeanor! The amendment passed the vote for inclusion into the broader bill by a vote of 26-11 (read more about the vote here)! Fortunately, the Kansas State Senate voted to reject the broader gaming bill, killing the ban attempt for now. Nevertheless, the threat is real.

The effort to criminalize online poker in Kansas sets a bad precedent and is an affront to our personal freedoms. Had it passed into law, Senator LaTurner’s amendment would have had a devastating impact on the future of poker in Kansas. It would have prevented Kansas from joining states like New Jersey, Nevada, and Delaware which are already licensing and regulating online poker.

The criminal prohibition proposed by Senator LaTurner would do nothing to protect consumers from unscrupulous operators. It would do nothing to address problem or underage participation. And, it would completely ignore the opportunity for Kansas to raise much needed revenue for important priorities like education and infrastructure.

I encourage everyone to keep in mind the fact that the fight for poker is far from over! Let’s all stay engaged and win this.

PPA Fighting for Poker in Courtrooms Across America

As the PPA’s efforts to expand your ability to play poker continues in state legislatures, so does the PPA’s legal effort to see poker excluded from many existing statutes prohibiting illegal gaming. At present, as PPA’s Litigation Support Director and Board Member Patrick Fleming observes, “We are truly at an historic moment in our litigation efforts. As many know, the first ever examination by a Federal Court of whether poker should be classified as a game of skill occurred last year in the case of US v. DiCristina. Poker’s victory in that case is now on appeal in the US 2nd Circuit and last week was the deadline for filing the first set of briefs. If the 2nd Circuit agrees with the lower court’s ruling, US v. DiCristina could possibly end up being just as important to poker’s future as Brown v. Board of education was to the future of the civil rights movement and other similar cases were to other causes.”

Coordinated by PPA, and working in concert with DiCristina’s lawyers, an impressive number of people and organizations (including PPA) filed “Friend of the Court” briefs in support of the argument that poker is not, and should not be, put in the same legal category as traditional casino gambling games. All of those briefs, as well as the briefs filed by the government and Mr. DiCristina’s lawyers, can be found and read or downloaded from the PPA website at /resources/legal. Patrick also noted that not all the briefs are filled with just statistics and legalese; those not wanting to get that deep into legal argument will still enjoy reading the poker history lesson provided in the brief from Jim McManus or the description of player’s thinking while playing a hand found in the amateur players’ brief.

And while winning in court does not eliminate the need for new legislation, it, Fleming noted, “certainly helps make the job of convincing legislators to see poker in a different and better light that much easier.”

Texas Hearing

Poker is a hot topic in Austin! In fact, the Texas Senate Committee on Business and Commerce began a hearing today at 8 am CT to discuss licensing bricks-and-mortar casinos, which would create new opportunities for all of us – state residents and non-residents alike — to play poker in the Lone Star State. PPA Texas State Director Matt Allen is scheduled to testify on behalf of the Texas poker community at this important hearing!

Illinois: Take Action

Illinois has a real opportunity to become a hub for online poker in the Midwest.

In his State of the Budget speech, Governor Pat Quinn publicly outlined rigorous requirements for any gaming expansion in that state. He stated that proposals must have “proper ethical safeguards” in place before he would sign such legislation into law.

Governor Quinn rejected two earlier proposals, expressing concern that they did not include sufficient ethical safeguards and proper regulation. The casino gaming proposal now on the table appears to address his concerns as they relate to bricks and mortar casinos. Should this bill become law, it would authorize five new casinos and would also authorize real money online poker and online casino gaming websites, accessible to residents of the state.

However, the governor expressed skepticism over the online poker and online casino gaming provision. “It’s a brand new idea and there hasn’t been much review on that at all. Anytime you have something brand new it shouldn’t just be thrown into a bill at the last minute.”

I encourage all Illinois poker supporters to phone Governor Quinn at (217)782-0244 and to email him (click here) right away. Let’s tell him online poker is not a new concept and that, in fact, licensing this is long overdue!

Louisiana Update

State Representative Mike Huval has introduced an online poker and online casino gaming study bill. HCR3 (link) would study the feasibility and practicality of authorizing Internet poker and Internet casino gaming in Louisiana.

While a study bill is a step in the right direction for which we thank Rep. Huval, PPA would prefer an actual online poker bill. I encourage all Louisiana poker supporters to contact their state lawmakers to ask them to support HCR3 while also asking for a bill that authorizes online poker.

With last month’s major victories in New Jersey and Nevada, I wish to take a moment to thank everyone who has supported the fight for poker and who has contributed their time and effort to the cause. We poker players would not be reaping the fruits of these years of efforts now had we not all come together to organize and to stand up for ourselves!

This is not a fight we players sought. We all simply wished to be left alone to play the great game of poker without bothering anyone else. Sadly, powerful opponents set their sights on our game and on our rights. They engaged in a campaign of hyperbole and, in some cases, outright lies in their efforts to demonize our game and those of us who enjoy it. They achieved several victories along the way, most notably passage of the Unlawful Internet Gambling Enforcement Act of 2006. Testifying to their strength was its 317-93 margin of victory in the House (and, yes, it was a freestanding bill at the time).

Since then, the poker community responded to this determined, organized opposition to our right to play by fighting fire with fire. We organized, just as they had. We worked with pro-poker lawmakers to introduce legislation. While the early bills were huge underdogs, they helped us to lay the foundation for our fight by giving us a platform upon which we could make our case and demonstrate support for our game on Capitol Hill, in statehouses across the country, and in the mainstream media.

Being organized allowed us to have strong lobbyists fighting for us on the Hill. Our letters, phone calls, and social media grassroots activism gave them the ammo they needed for their fight, while the lobbying effort gave us our voice on Capitol Hill. The synergy did not end there. As we increased the likelihood of online poker becoming authorized in the U.S., supporting us became +EV for other interests, including U.S.-based potential providers, state lotteries, some tribal interests, and others. Thus, rather than opposing us, our efforts helped bring many stakeholders over to the side of the poker community.

So, with Congress unable to pass laws strengthening UIGEA but slow in moving on legislation to license and regulate the game, the states are rapidly moving forward. As the first few dominoes have fallen, we are in a great position for our push across our great nation! With recent news that Congress may look to take up licensing legislation again this year, it looks like we may now have a race between the states and Congress to take action.

Survey of New Jersey PPA Members Concerning Anti-Competitive Actions in Their State

On February 26th, the Garden State made history when Governor Chris Christie signed a law that authorizes the state to license and regulate Internet poker and Internet casino gaming. A key component of this law is the economic vitality it promises to bring to Atlantic City and the entire state of New Jersey. Now, that economic success is under attack.

Recently, the American Gaming Association filed a petition to block the sale of the long-struggling Atlantic Club Casino to PokerStars, which has plans to revitalize the casino as an East Coast poker mecca. Denying PokerStars the ability to purchase the Atlantic Club will jeopardize thousands of Atlantic City jobs and economic renewal for a boardwalk casino that is near bankruptcy. It would also mean that PokerStars would be ineligible to offer Internet poker in New Jersey, as the law allows only licensed Atlantic City Casino companies to operate an online gaming web site.

The concern here for PPA and for the poker community is primarily on the impact on market competition. PPA’s strategy for delivering the lowest rake and optimal playing experience relies on market forces, which are dependent on maximum competition among sites. Anti-competitive efforts like this are harmful to us as consumers.

In a strongly worded letter, PokerStars has responded to the AGA petition. The outcome will not be determined until the state’s gaming commissions meets in the coming weeks. In the meantime, to gauge the New Jersey poker community on this matter, PPA sent a questionnaire to the New Jersey membership and 998 members responded. Here are the results:

  1. Have you played real money poker or play money poker on PokerStars?: 94% yes, 6% no
  2. How would you rate your experience on PokerStars? (5 = excellent, 1 = poor): 85% voted positively (4 or 5), 3% were negative (1 or 2), while the rest were either neutral (3) or answered that they had never played on the site.
  3. Do you think PokerStars should be allowed to purchase the Atlantic Club Casino? 96% yes, 4% no
  4. As a player, would you visit a bricks-and-mortar casino owned and operated by PokerStars? 94% yes, 6% no
  5. As a player, would you like to have the option to play on an Internet poker web site operated by PokerStars or supported by PokerStars software? 96% yes, 4% no
  6. Do you believe that the New Jersey Casino Control Commission should be the authority that determines who is suitable for a license? 73% yes, 27% no
  7. Do you believe PokerStars is a “bad actor” that should not be licensed in New Jersey? 5% yes, 95% no
  8. Do you support the AGA effort to block PokerStars from being licensed in New Jersey? 6% yes, 94% no

Texas Activism

Poker is becoming an ever hotter topic in Austin. With several bills pending in the Texas House that would allow for poker in card rooms, social settings or online, we may be seeing the start of a dynamic shift in that state away from outdated gaming laws.

These bills may be brought up for legislative hearings in the near future. Last Sunday, PPA Texas State Director Matt Allen sent an email to all our Texas activists with a list of specific actions they can take action in support of these ongoing efforts. I encourage everyone in the Lone Star State to follow Matt’s lead!

Preet Bharara, U.S. Attorney for the Southern District of New York, announced late last week that the Garden City Group will serve as the claims administrator to oversee the Full Tilt Poker player remission process. This is terrific news and is an important milestone. It will still be a while for this to complete, of course, as there is a defined governmental process to be followed, but we are clearly on course for repayment.

I encourage every U.S. player owed money by Full Tilt Poker to visit www.fulltiltpokerclaims.com and to sign up there for email updates. As this sign-up is just for updates, there is no need to worry about matching your information with that on file with Full Tilt. Still, for what it’s worth, I logged into Full Tilt and used that information to ensure my email and name matched exactly (“Richard” vs. “Rich”, middle initial vs. name, etc.).

The PPA Full Tilt Poker Player Remission Resource Center is at /repayment. We continually update the site with the all the information you will need.

PPA has done a lot with the Department of Justice to represent our collective interests as players. PPA made the case that we players we are victims of a fraud deserving remission and explained why remission should be based on our balances versus our deposits. Seeking to streamline the application process, we also shared what players should reasonably be expected to have in terms of documentation. And, PPA is still there making our case. Had we players not organized ourselves, we would have no input into this process at all. I thank everyone who took a stand to organize and to fight together as a unified team!

New York Update

As I mentioned in last week’s update, the New York State Senate passed a non-binding budget proposal that includes a provision to allow for licensing of online poker in the state. PPA New York State Director Randy Hagen and PPA were instrumental in reaching out to Senate leadership to encourage them to include the online poker provision in the Senate budget.

PPA has since continued dialog with lobbyists and lawmakers in Albany in an effort to include Internet poker licensing as an amendment to the state’s budget. After all, licensing of Internet poker would provide players with strong consumer protections and give the state tens of millions in revenue without raising taxes. The budget negotiations are still ongoing but, in all frankness, it does not appear likely at this point that the poker amendment will make it into the final budget bill.

The fight is now just beginning in New York. The state legislature will reconvene on May 2nd. We will push for Internet poker legislation to be considered along with an effort to bring brick-and-mortar casinos to the state. We look forward to making the case that New York needs to be a leader for licensing of online poker. It is a good bet for the players and for the state!

Poker Bills Pending in the Texas Legislature

State Senator Leticia Van de Putte is sponsoring two bills (SB 1103 and SJR 43) to opt Texas into federally licensed online poker, should such a bill pass the U.S. Congress. We are working with her to encourage her to expand her legislation to allow Texas to compact with other states like New Jersey that recently passed online poker legislation and may be offering real money play by the end of this year.

In other news, later this week we expect to learn if a hearing will be scheduled on other Texas poker bills. As I mentioned in last week’s update, Representative Eddie Rodriguez introduced HB 292, the Poker Gaming Act of 2013, which designates poker as a “game of skill.” Additionally, Representative Ryan Guillen filed HB 2098, the Social Poker Gaming Act of 2013, which would provide for social poker clubs in Texas. PPA is working with Texas lawmakers to ensure poker players have a strong presence at any hearings that are scheduled.

Last week, PPA Executive Director John Pappas traveled to California to meet with the state’s lawmakers regarding their push for Internet poker. While in Sacramento, Pappas also met with other leading stakeholders, including Indian tribes and state regulated card rooms, to discuss the prospects of legislation passing this year. Currently, the state has one full bill pending, SB 51, and a placeholder bill introduced as well.

Given its massive population, California represents the nation’s largest potential market for Internet poker. Thusly, there are several competing interests that want the opportunity to offer online poker to California residents. Principal among them are the state’s Indian tribes who already have an exclusive arrangement to offer most gaming in the state. Unfortunately, the tribes are not uniform in their desire to have online poker, so distinct battle lines have been drawn between the tribes who want Internet poker and those who do not. Part of Pappas’ mission for this trip was to talk to opposing tribes and help them better understand the opportunities available through licensed online poker.

We feel tribal governments in particular should view Internet poker as a way to expand their brand and revenue. According the National Indian Gaming Association, a mere one percent of Indian gaming revenue is derived from bricks and mortar poker. The Internet can only help grow that number, as it provides a unique marketing opportunity to attract new customers from across the state, the country, and potentially the world, to their bricks and mortar operations. Poker tourism is booming globally and Internet poker can help California become a global destination for poker players from across the U.S. and around the world.

Pappas also told lawmakers and others that the state needs to think nationally and even globally when it comes to Internet poker. As Pappas explained, by its very nature, Internet poker is borderless. Establishing California as a national (and perhaps global) leader for Internet poker would also create thousands of high paying, high-tech jobs for the state. The state already has a deep commitment to Internet innovation. Licensed Internet poker would produce a new avenue for research, investment, and California-led innovation for this burgeoning industry. PPA provided legislative language to amend existing legislation to allow California to engage other states in compacts or reciprocal agreements.

Finally, Pappas sought to bring the discussion back to the poker player. The debate in California has been dominated by how business will benefit from the new marketplace. Profitability and a pro-business environment are important, of course. However, this can only be achieved in a consumer-friendly market. Ultimately, we poker players will determine the future success or failure of Internet poker in California. Pappas offered ideas on how the state can foster a competitive market that provides the consumer choice and incentives to attract and keep customers.

At this time, the prospects for legislation in the Golden State remain unclear. There are a growing number of tribes who are now signaling their support for Internet poker in general. However, no tribes have come out in support of the current legislation. This could mean that there will be a third proposal emerging in the coming weeks.

With other states pushing forward, California needs to act soon. We expect Senator Roderick Wright to push for a hearing and a vote on this bill this spring. In the meantime, PPA will continue to educate lawmakers and leading stakeholders and help bring consensus around a set of principles that puts the players first and establishes California as a global leader for Internet poker.

New York Senate Includes Online Poker in Budget Proposal

Earlier this week, the New York State Senate passed a non-binding budget proposal that includes a provision to allow for licensing and regulation of online poker in the state! PPA New York State Director Randy Hagen and PPA were instrumental in reaching out to Senate co-leaders Jeff Klein and Dean Skelos to encourage them to include the online poker provision in the Senate budget.

PPA’s efforts in support of the 2012 court ruling (click here) that found poker to be a game of skill and not a game of chance as defined by a specific federal law helped open the door for New York to join Nevada, New Jersey and Delaware in passing online poker legislation.

Several Poker Bills Pending in the Texas Legislature

After years of grassroots efforts by the Texas poker community, three prominent Texas state legislators have introduced several poker bills. These bills, should they become law, will allow Texans to play poker in card rooms, at private social clubs and online.

Representative Eddie Rodriguez filed HB 292, the Poker Gaming Act of 2013, which designates poker as a game of skill and issues poker licenses to bingo operators, licensed pari-mutuels and Native American tribes. It also allows for charitable poker tournaments and provides consumer protections that currently do not exist in Texas.

Representative Ryan Guillen filed HB 2098, the Social Poker Gaming Act of 2013, which would provide for social poker clubs in Texas. The bill would allow club members to play in non-raked games and would allow licensed businesses to earn revenue through membership dues and food and beverage sales.

State Senator Leticia Van de Putte (SB 1103 & SJR 43) and State Representative John Kuempel (HB 3529 & HJR 141) have filed companion bills that would allow Texas to opt-in to any federal licensed online poker law, should one pass.

Illinois Bill to License and Regulate Online Poker Passes Committee Vote

Illinois State Director Bill Gentes reports that on March 8th, Illinois State Senator Terry Link introduced an amendment to Senate Bill 1739 (here) that would license and regulate Internet poker and Internet casino gaming. The amendment was passed out of committee by a 10-4 vote, with a full Senate vote expected soon.
