Support for online poker continues to grow. The National Governors Association (NGA) has written a letter to Congressional leadership expressing concern and opposition to attempts to implement a national prohibition on online poker. It was written on May 9th, but just released recently. I encourage you to check out this important letter of support here.

This comes while our opponents continue to stumble. Just yesterday, Texas Governor Rick Perry penned a poorly received anti-online poker op-ed for National Review, where he made an awkward attempt to argue that states’ rights are actually protected when the federal government takes rights from states. As of now, this op-ed has not received a single supportive comment. I encourage you to take a moment to make and upvote some comments (here).

Las Vegas Sands Corp. and CEO Sheldon Adelson have clearly been chastened by their lack of progress and public support. They recently pushed the American Gaming Association, of which LVS is a member, to withdraw its active support of regulated online poker. While AGA may no longer be playing a part in the legislative efforts, individual gaming companies, industry organizations like C4COP, and player groups like PPA will play a bigger role in advocating for our game.

In the center of this whirlwind is PPA Executive Director John Pappas. John pays a visit to our nation’s lawmakers and their staffs just about every day. Victories are built by preparation, and the continued preparation and preparedness of the poker community is a big reason our opponents are still shocked that online poker did not go away with the passage of UIGEA in 2006.

I encourage everyone to stay strong in this fight, as it is really heating up. Thanks!

Idaho Judge Rules Poker is a Game of Skill

Last week, a Boise, Idaho judge found that the game of Texas Hold’em is a game of skill. The PPA played a significant role in the positive outcome, providing the PPA member defendants legal advice as well as expert testimony support. The ruling is even getting some national attention. Today, CBS This Morning ran a news segment about the case and the growing discussion nationwide about skill in poker. This is certainly terrific, welcome news. Online Poker Licensing Bill Introduced in New York State Assembly

A few weeks ago, I shared the news that state Sen. John Bonacic (R-42), introduced S6913, a bill that would license and regulate online poker in that state. Now, Assemblyman J. Gary Pretlow (D-89) has introduced A09509, a nearly identical bill, to the NY State Assembly.

While we applaud the introduction of these bills we remained concerned that they contain provisions that arbitrarily limit the options players will have in licensed operators. Both bills contain “bad actor” clauses designed to block sites that served US players after the 2006 passage of UIGEA. We urge New York lawmakers to consider that an open, competitive market will foster innovation and likely lead to greater revenue for the state.

The bills are, as I mentioned prior, being characterized as icebreakers to get the discussion started in the Empire State. While it is unlikely to pass into law this year, it is a great first step that will surely serve to move the ball forward.

Cyber-safety Charity WiredSafety Supports Online Gaming Regulation

WiredSafety, the nation’s leading cyber safety organization, has issued a new statement in support of licensing and regulation of Internet poker. The group also voiced opposition to proposals to ban online poker.

Founder and Executive Director, Dr. Parry Aftab has testified before many legislative bodies on this issue, most recently in Pennsylvania.

Pennsylvania Op-Ed

PPA Pennsylvania State Director Willard Darling penned a terrific op-ed for Pennlive.com and the Patriot News newspaper, highlighting why his state should act now to license and regulate Internet poker. I encourage you to check it out.

[Indiana] Governor Mike Pence Doesn’t Believe States are Sophisticated Enough to Regulate Internet Poker

On May 1st, Governor Mike Pence sent a letter to the Indiana Congressional Delegation urging them to support federal legislation that outlaws Internet poker in there and throughout the nation. Though he acknowledges states should have the right to license Internet gambling, he argues that they are not sophisticated enough to enact and enforce the same stringent consumer protections over the Internet that are employed by brick-and-mortar casino’s and lotteries.

On Monday, Indiana State Director Bruce Hugon sent a call to action asking poker players to send a letter to Governor Pence letting him know that they disagree with his assessment. If you live in Indiana, please check you inbox for further calls to action.

[Pennsylvania] Government Bi-Partisan Committee Releases Study Favoring Online Gaming

Pennsylvania Legislative Budget and Finance Committee (LBFC) released a study that found licensed and regulated online gaming in the state to be a benefit to the state. In a press release, PPA Executive Director John Pappas stated “Following on the heels of last week’s hearing in the Pennsylvania House, today’s study truly changes the discussion in the state from if there will be licensed and regulated online gaming in Pennsylvania to when”. Pappas goes on to say “I believe the estimates we saw today from Pennsylvania, and the revenue reports from states that currently have an online marketplace, are just the /beginning of the true economic benefit to states from online gaming.” To read the full press release, click here.

[New York] Online Poker Bill Introduced to the State Assembly

On May 5th, NY State Assemblyman J. Gary Pretlow (D-Mt. Vernon) introduced Assembly Bill 9509 for “allowing certain interactive poker games” (read here). This bill has a counterpart in the NY Senate, S 6913. The A 9505 bill contains clauses for consumer protections, addressing problem and underage gaming, interstate partnership agreements, and ineligibility of ‘bad actors’. With neighbors such as NJ, DE already offering online poker and PA reviewing the possibility, there is potential for NY to provide safe, regulated online poker that can be taxed by the state. However NY state representatives need to hear from their constituents that they want safe, licensed, regulated online poker.

PPA Testifies in Pennsylvania Today!

Today, the Pennsylvania House Democratic Policy Committee is holding an informational hearing to discuss the future of Internet poker and other forms of Internet gaming in the Keystone State. PPA executive director, John Pappas, has been invited by the committee to provide expert testimony. As you know, Pappas has testified before numerous state legislatures as well as the U.S. Congress explaining why lawmakers should support legislation that responsibly regulates Internet poker. Pennsylvania is taking a serious look at regulating Internet poker and other forms of gaming. Believe it or not, the state is the second largest gaming state (by revenue) just behind Nevada. In the coming weeks the Pennsylvania Legislative Assembly will release a report they commissioned to analyze the potential impact of online gaming in the state. Once this report is released the push for legislation will likely accelerate as the state seeks to keep pace with this growing industry.

PPA’s Open Letter to Lock Poker

Last week we released a letter that PPA board members sent to Lock Poker seeking information from the company about repayment of player funds that have been significantly delayed. If you’ve been a loyal reader of the PPA weekly update you will know that since February, the PPA has been alerting its members about concerns with Lock Poker’s business practices and its treatment of their customers. The PPA Board members who took last week’s step of issuing public correspondence to Lock Poker did so for many reasons, and we are glad we did.

Our first and foremost reason for issuing the letter was to directly address the concerns of PPA members. In recent weeks many of you have asked that we formally attempt to make contact with Lock Poker on your behalf. Second, we believed that a formal inquiry was needed to generate more public awareness about the deficiencies of Lock Poker, even if the company ignores it (as it so far has). Since only a small percentage of PPA members and the online poker community regularly visit poker forums where the issues of Lock Poker have been discussed, our formal inquiry was designed just as much to spread the word to all players about the extreme risk of depositing on Lock Poker as it was to actually get Lock Poker to address their issues. In our letter we laid out very clear reasons why any player should avoid playing on this site and we hope that our message reached players who were otherwise unaware.

Finally, our letter was intended to put on notice everyone who continues to serve as a marketing affiliate for Lock Poker that their continued support of the company is clearly no longer acceptable to the player community. We strongly urge any company or website that continues to promote Lock Poker to cease their arrangement with the company until its customers are paid what they are owed. Taking such steps at this time is the right thing to do to show that the poker community will not tolerate an online poker site that is unresponsive to players’ financial rights.

We have heard from many of you thanking the PPA for the letter, especially since this is not a traditional role for the organization. As you know, our advocacy efforts are focused on advancing legislation that will appropriately license and regulate poker and Internet poker across the U.S. It is our firm resolve that the result of these efforts will one day be an online poker marketplace truly accountable to the players; a marketplace where rogue sites can be held directly and legally responsible for their actions. We view this to be our primary mission and we appreciate the support and activism of the poker community as we promote these principles in Congress and in state capitals across the country.

Conservative, Free Market Groups Tell Congress to Oppose Online Gambling Ban

On April 28th ten conservative and free market organizations sent a letter urging the House and Senate Judiciary Committees to oppose bills introduced by Rep. Jason Chaffettz and Senator Lindsey Graham. The PPA applauds these organizations for taking a stand against the effort to expand the Wire Act and prohibit online poker and other, select, online gaming nationwide. PPA executive director praised the letter and stated, “We hope other groups will join the effort to protect the freedoms of individuals by allowing states the opportunity to provide poker players with a safe and regulated online gambling environment through clear laws and strong enforcements, while adding benefit to their state through increased revenue and jobs.”

With the poker community focused on defending against Sheldon Adelson’s ban attempts, Wednesday’s online poker hearing in California was certainly a breath of fresh air. It also served to remind us that we are still on offense, with the momentum. In fact, Las Vegas Sands was relegated to testifying 32nd out of the 33 witnesses at the hearing and was a complete non-factor in the discussion about the future of Internet poker in California.

The hearing was overwhelmingly positive. 30 of the witnesses were in favor of licensing online poker in California, one was neutral, and just two (including Las Vegas Sands) were opposed.

The discussion focused on the specifics of how Internet poker regulation will happen and who should be allowed to offer the game. Some suggested PokerStars should be blocked by a “bad actor” clause, while others wished for regulators to determine suitability for licensing, rather than it being a political decision. Yet others pointed out the date chosen – passage of the Unlawful Internet Gambling Enforcement Act of 2006 – was arbitrary, as UIGEA did not ban anything (it was an enforcement measure) and that sites offering services in the US prior to UIGEA’s passage were given a free pass. There was also considerable debate about which incumbent California gaming operators should be licensed Internet gaming operators. The state’s racetracks made fervent arguments to be included in the legislation.

PPA Executive Director John Pappas was invited to testify, but conflicts prevented his attendance. We offered and alternate to represent the players at the hearing. However, with so many pro-poker voices already confirmed to attend, a substitute for Pappas was not given the opportunity this time.

This was a terrific hearing that bodes well for getting more states on board with authorized online poker.

PPA Letter to Lock Poker

Due to the continued cash-out issues players are experiencing with Lock Poker, PPA today sent a letter to Lock demanding action on this issue. I encourage you to read this letter here.

In the letter, signed by PPA Executive Director John Pappas, PPA Litigation Support Director Patrick Fleming and me, we demand answers to the following:
  1. Does Lock Poker keep players’ funds segregated from operating funds? If so, what mechanism is used to accomplish this separation?
  2. Does Lock Poker have, or will it be implementing, a system to organize its payment processing so that those who have been waiting the longest will be given priority in future payments?
  3. Does Lock Poker have a timeline of its plan to pay its players in full?
  4. Will Lock Poker immediately provide open, accurate, up-to-date information regarding time required to process customer withdrawal requests?
In the meantime, we encourage extreme caution when depositing on Lock Poker. We also strongly encourage affiliates to remove Lock Poker ads and positive reviews. In the current state, these are at best misleading.

In the last update, PPA Executive Director John Pappas and I told you about the National Call to Action. I am very happy to report that many players are responding enthusiastically. Thousands of tweets and emails demanding our rights have been sent to lawmakers already. We ARE being heard on Capitol Hill!

For this week, please be sure to finish up the tweets and to ask your friends and family to send the prewritten, fully editable letter to Congress. I know you will do that. I also ask that you call your lawmakers and make a personal visit to ask for support for poker. I know the latter two are harder and take time and commitment, but it really is worth it. A single face-to-face communication with your lawmaker is one of the most impactful actions you can take for poker. Congress will be in recess for another week so there is still time for you to arrange an in person visit in your hometown. I hope you can make time for this important action. It makes a huge difference!

John Pappas has been on Capitol Hill just about every day, meeting with lawmakers to tell them we demand our right to play. Industry lobbyists are there with a similar message. Our efforts give them the ammo they need, and their lobbying efforts amplify our grassroots efforts. It is synergy that makes these actions virtually obligatory!

Citizen Lobbyists for Poker

As part of the National Call to Action, many poker players and enthusiasts met with their lawmakers or their staffs. I wish to share with you the experience of one such activist.

Dr. Steve Friedlander, known as Renodoc on the Two Plus Two Forums, took the time to meet with Utah Senator Mike Lee’s office. Senator Lee is cosponsoring the ban bill, but that did not deter Dr. Friedlander. To the contrary…the good doctor knew the Senator needed to hear from the poker community. He was able to share, professionally and respectfully, many reasons Senator Lee should reconsider his position. Dr. Friedlander then followed up with a well-written letter that summarized the discussion.

In the last update, I shared the news that Senator Lindsey Graham (R-SC) and Congressman Jason Chaffetz (R-UT) introduced Senate bill S. 2159 and House bill H.R. 4301– bills that would ban online poker throughout America. The poker community responded quickly, via PPA tools and the Poker Daily Action Plan, with office visits, emails, phone calls, and social media activism, ensuring these lawmakers know where their constituent stand on this issue.

This is just the beginning. I encourage you to take a moment to watch an important update from PPA Executive Director John Pappas:


Take Action

To put this grassroots advocacy into high gear, PPA has rolled out “Take Action: Fight Back Against Online Poker Prohibition Effort.” Please be sure to visit this action page at /fight-the-ban and take action for our game.

Lawmakers will be in their home districts for the next two weeks, so be sure to pay them a visit and remind them that they represent you in D.C.

Online Poker Licensing Bill Introduced in New York

A new bill to license and regulate online poker in the state of New York has been introduced by state Sen. John Bonacic (R-42). Read the full text of the bill here.

The bill is being characterized as an icebreaker, even by its sponsor, to get the discussion started in the Empire State. While it is unlikely to pass into law, it is a great first step that will surely serve to move the ball forward.

Yesterday, the long-discussed legislation to ban online poker throughout America was introduced in the Senate by Senator Lindsey Graham (R-SC) and in the House by Congressman Jason Chaffetz (R-UT). I encourage you to check out PPA’s response.

The legislation – laughingly entitled “Restoration of America’s Wire Act” – is cosponsored by Senators Dianne Feinstein (D-CA), Mike Lee (R-UT) and Kelly Ayotte (R-NH); and Representatives Tulsi Gabbard (D-HI), Jim Matheson (D-UT), Lamar Smith (R-TX), Jim Jordan (R-OH), Trent Franks (R-AZ), George Holding (R-NC), Frank Wolf (R-VA), James Lankford (R-OK), and Emanuel Cleaver (D-MO).

Additionally, Governors Rick Perry (R-TX), Nikki Haley (R-SC), and Bobby Jindal (R-LA) have come out in favor of a Congressional ban.

On our side, the Democratic Governors Association sent Congress a letter in “strong opposition” to this legislation. The letter was signed by the Chair, VT Governor Peter Shumlin and the Vice-Chair, NH Governor Maggie Hassan. Longtime poker stalwart Congressman Joe Barton (R-TX) once again spoke up for our right to play, as did Senator Robert Menendez (D-NJ). And, of course, former Reps. Mary Bono (R-CA) and Mike Oxley (R-OH), co-chairs of the Coalition for Consumer and Online Protection (C4COP), are actively opposing any attempt to expand the Wire Act.

Nevada Senators Dean Heller (R) and House Majority Leader Harry Reid (D) reaffirmed their support for online poker while also supporting expansion of the Wire Act to include non-poker wagering activities. However, the backer of this prohibition effort is Sheldon Adelson, billionaire CEO of the Venetian Casino, who has poker firmly in his crosshairs. As things stand today, it does not seem this will end with a carve-out for poker. So, there is no compromise. We will have to win this fight.

Don’t let Sheldon Adelson take your right to play from you. He may have millions of dollars to spend on this, but we poker players and enthusiasts have millions of supporters and voters among us. Will you do your part to stand up for your right to play today?

I have shared with you all of our successes as a community at beating back Venetian / Las Vegas Sands and their CEO Sheldon Adelson’s efforts to ban online poker across America. We have won every battle thus far, for which we all give the credit to the great grassroots activism of the poker community.

I also mentioned that Adelson will fight harder, lobbying anti-gaming lawmakers in an attempt to create an appearance of growing opposition while simultaneously making state-by-state advocacy more challenging. Unfortunately, he is pushing forward as predicted. We know Adelson has one more lawmaker ready to ban your right to play – Utah Rep. Jason Chaffetz – and there will be more to come. He and the Venetian are spending tens of millions of dollars on this anti-online poker jihad, but it is something we can defeat. While he may have millions of dollars to spend on this, we have millions of poker players demanding our right to play!

The threat is real, and it must be taken very seriously by the entire poker community. It will take a unified effort to beat this back. PPA Executive Director is doing his part. I am doing my part. Many in the poker community are acting as one, doing their part. Can I count on you to do your part?

Minnesota Update: Online Poker Debate

Earlier this week, PPA Minnesota State Director Mike Qualley was on The John Williams Show, which airs live on WCCO-AM. He debated Anne Meeks, founder and CEO of The Freedom Foundation of Minnesota, on the merits of licensing online poker.

I am not sure what freedom Ms. Meeks espouses, but am pleased to report that Mike did a terrific job representing freedom and the poker community in the Gopher State.

Lock Poker Issues

I wish to remind everyone that players have been experiencing extreme difficulties in withdrawing money from Lock Poker for some time. The post-Black Friday offshore US-facing online poker market has been caveat emptor, so every player choosing such a site needs to be vigilant.

PPA continues to call on Lock Poker to do the right thing and to play its players. I encourage you to read the thread on Two Plus Two regarding Lock Poker’s payment problems before making a deposit there. I also encourage you to read a Two Plus Two thread by poster IHasTehNutz. He will be a guest on next week’s Poker Advocacy webcast, where he will update the community on Lock Poker’s issues.

The ecstatic community mood resulting from players getting their Full Tilt Poker money back has gone full bore. Even poker forums and social media cannot contain this enthusiasm. I think it is so terrific that we have come so far as a community. This really is an outcome that could only have happened with an organized effort.

As I mentioned last week, many players have told me they are donating 10% of their recovered funds to PPA. My remission is slated for wave 2 but, touched by the outpouring of support I have seen for the fight, I have already donated my 10%. PPA can do a lot with people taking action, but we do need funding to keep growing as a strong, united advocacy effort for our game. Please considering doing what you can to support the fight. Thank you.

Earlier this week, the Massachusetts Gaming Commission held a forum on online betting. Needless to say, PPA had representation in attendance and to speak with fellow attendees and speakers. It went quite well. The Boston Herald’s story was headlined: Gaming chief: ‘We can’t wait’ for online betting.

Colorado Charity Poker Tournament

The Tri-Lakes Chamber of Commerce and Visitor Center hosted their Texas Hold ‘Em tournament on Saturday, March 8th. The event, sponsored in part by Poker Advocacy with Rich Muny producer OnTilt Radio, was a great success. PPA Colorado State Director Robin Jones is CEO of OnTilt.

Proceeds from the event will benefit the Chamber and The Homeless Foundation.
