Saturday’s New England Town Hall was a great success. We thank everyone who volunteered their time and effort to make this happen!

PPA Executive Director John Pappas, Director of Grassroots and External Affairs Drew Lesofski, Litigation Support Network Director & Board Member Patrick Fleming, MA State Director Dan Brown, CT State Director Chad Lehofer, VT State Director Dave Sawyer, and I met many great, active poker players at the event. We shared all that PPA is doing and engaged in a terrific dialog on the big issues. The town hall event was followed by a charity poker tournament that benefited ALS research.

Poker lost a great ambassador this week…

It is with great sadness that I share the news that poker pro, author, and webcast host Lou Krieger lost his fight with cancer earlier this week. He was a great force within the poker community and a terrific advocate for the game. We appeared on each others’ webcasts a few times. He was a class act and a true ambassador for the game who will be greatly missed.

The New England Town Hall is upon us. PPA Executive Director John Pappas, Director of Grassroots and External Affairs Drew Lesofski, Litigation Support Network Director & Board Member Patrick Fleming, several PPA state directors and I are all gearing up to head to greater Boston to spend this Saturday afternoon with the poker community. We are all looking forward to meeting many of you there, sharing all that PPA is doing, and answering all of your questions!

The Town Hall event itself is free. We are hosting an optional charity poker tournament after the meeting. The tournament will be a lot of fun and will help support a great cause, but please be assured that you do not have to participate in the tournament to attend the Town Hall.

PPA continues to lobby Capitol Hill for player-friendly poker legislation. To that end, PPA Chairman Alfonse D’Amato recently sent Senate leadership a letter on behalf of the PPA membership requesting that several player-friendly measures — including improvements in the state opt-in procedure, reduction in the planned blackout period, fair player taxation, and other important issues — be included in the upcoming online poker bill.

Full Tilt Poker Remission

I have an update on the FTP player remission process. Yesterday afternoon, the Department of Justice released the following statement on FTP player repayment:

November 20, 2012—Victim Update. The United States Attorney’s Office for the Southern District of New York is evaluating applicants for the position of Claims Administrator to handle petitions for remission for U.S. victims of the alleged fraud that Full Tilt Poker committed relating to player funds. The United States Attorney’s Office expects that the Claims Administrator will be selected and begin work in January 2013.

PPA extends its congratulations to Board Member Greg “Fossilman” Raymer for capturing an unprecedented fourth Heartland Poker Tour title this week. Greg is a great player and he is an outstanding ambassador for the game. Thanks for all you do for the PPA and the poker community… and keep on winning!

I have been hearing a lot from poker players with questions on the Department of Justice’s remission of Full Tilt Poker player balances. Well, I am pleased to let you know PPA met with the DoJ on Tuesday on this issue. Here’s PPA’s statement on the meeting:

PPA Statement Regarding Meeting with the Department of Justice

“Today I met with officials from the U.S. Department of Justice (DoJ), Asset Forfeiture and Money Laundering Section. This is the division of the DOJ that oversees the process of remission for victims of crimes. The settlement in United States v. Pokerstars, et al. designated for refunds to U.S. players over $200 million in funds forfeited on April 15, 2011 by PokerStars, relating to their FultTilt Poker accounts. I was joined by PPA counsel Marc Zwillinger and Ken Dreifach from the Washington D.C.-based law firm ZwillGen, PLLC. It was a cordial and productive meeting. We provided DOJ with information and insights on what the player community expects from the remission process, and how we believe such a process ought be administered to assure fairness.

Our first priority was to reaffirm our earlier assertions from an August 8, 2012 letter that 100 percent of player account balances be made available to players through the remission process. We laid out compelling legal and practical arguments why full repayment was the only equitable solution. We also raised the issue of “player point” balances on Full Tilt Poker and encouraged the DOJ to recognize the inherent value of these points when they consider what a player is owed. Our thoughts on these matters were well received; however, it was clear from our discussion that no decisions have been made at the DoJ regarding the manner of repayment of player balances. Nevertheless, we have provided them with a clear picture of the expectations of the player community.

Secondly, we shared our thoughts on a streamlined process for players to apply for and receive their funds. We emphasized the need for a flexible approach to player authentication and verification. While they would not confirm so in the meeting, we are hopeful that the DoJ has sufficient means to authenticate players based on the records such as user name, passwords, security questions and email addresses.

Our third objective was to get a sense of timing. Unfortunately, completion of a refund claims process is a long way away. The first step in this process will be the Department’s hiring of of a third-party claims administrator, after a bidding process: there is no current date certain for that selection to occur. But it was evident that even when a claims administrator is hired, forfeiture and remission procedures require that a substantial administrative process be adhered to before players begin seeing their funds. The PPA will remain vigilant in our advocacy for the players. We are also mindful of the staffing and resource limitations of the Department – and the numerous other forfeiture cases they are administering — and we thus have offered our assistance to help them navigate the complexities of the issues and hopefully expedite the refund process.

This is certainly not good news for those poker players still awaiting the return of their money, but it is all the news the PPA can provide at this time. Beyond that the PPA can only pledge to continue its work with the DOJ and do everything it can to help the DOJ get the process moving as soon as possible. The PPA’s legal team is already working on specific methods to help accomplish this objective.

While there were not many answers to come from this meeting, I do believe that it was beneficial and that there is a clear record for the Department to make the right decisions with respect to the player remission process. We fully expect to keep a continued and open dialogue with the Department and we will continue to update you as more information becomes available.

Election Day has finally come and gone, but our political effort is ramping up. That’s because the online poker bill is getting teed up for potential action in Congress!

The bipartisan online poker bill (read here) will potentially see introduction this month, in what is known as the lame duck session of Congress. With the distractions of the election over, this is a great time for the poker community to ensure our voices are heard.

Let’s all take advantage of this by reaching out to our lawmakers today via the PPA fully editable prewritten letters to lawmakers! It has been a full month since my last request for you to send these, so please go ahead and send them again. Simply click the buttons below (or here). In less than thirty seconds, you can send these emails directly to the inboxes of all your elected federal and state representatives.

The Election, PokerPAC and You

This week’s elections proved to be significant for the poker community. 95 percent of the PPA’s “A” rated members of Congress who were up for reelection are returning to Congress. Additionally PokerPAC, PPA’s political action committee, endorsed 56 candidates, 53 of whom won reelection. This is a very good outcome for the poker community and bodes well for the future of our efforts. Also of note is the fact that three members of Congress who were “F” rated by the PPA — Brian Bilbray, Mike Pence and Cliff Stearns — will not be returning to Congress in 2013.

At the state level, PPA scored a major victory for poker in Maryland through our endorsement and activism in support of Question 7, a ballot initiative that will bring card rooms and a new destination casino to Maryland. PPA’s grassroots activity in that state was critical in passing this closely contested ballot measure. We also worked with WSOP™ Champion Greg Merson, a Maryland native, to amplify his terrific advocacy for Question 7. While there were a number of forces at play, we can earnestly say that poker players did a major part in providing the margin of victory for this player friendly initiative in Maryland.

While the PPA did not endorse a presidential candidate, it is viewed by industry analysts and Washington lobbyists that the Obama administration may more favorable to licensing and regulation of Internet poker than would have a Romney administration. This is largely because, while the Obama administration has been largely neutral on the issue of online poker, both Gov. Romney and the 2012 Republican Party Platform stood opposed to online poker. We are hopeful that the pieces are in place for a real effort to get a bill done during the “lame duck” session of Congress that will begin later this month. Harry Reid, an advocate for Internet poker, remains the leader of the U.S. Senate and Dean Heller, a Republican senator who is an ardent support of our rights to play, won reelection and will be an important voice during the coming weeks.

We can’t just hope for success, though. As a community, we need to stand up for our rights and advocate for this common sense legislation. Start with sending your emails to Obama and Congress, participating in the Daily Action Plan, and staying tuned as we ask you to turn up the grassroots over the next several weeks!

Shuffling the 2012 U.S. Online Poker Survey

Did you know?

According to U.S. Poker Survey:

63% of respondents in the treasured swing state of Ohio stated they would consider voting against their registered party candidate IFthe other Presidential candidate supported licensing and regulating online poker for the U.S. while 25% would remain undecided.

Just a mere 12% paneled stated they would not make a change regardless of their candidate’s stance on legalizing and regulating online poker. Regarding Ohio, a huge electoral state that regularly decides the Presidential election, would it not have been wise for both President Obama and Governor Romney to try capturing these votes with a simple statement supporting online poker?

With all that is going on the poker community, including the online poker bill I mentioned last week (here), proposals for new B&M poker in Maryland and across the US, and the challenges the game still faces, I am pleased to announce that PPA will holding a town hall meeting in greater Boston on December 1st! Please save the date and stay tuned for updates as we finalize the details.

If you tuned into the WSOP Main Event final table coverage this week, no doubt you saw many of the finalists proudly wearing PPA patches. As the game progressed to the final three, it was terrific seeing all three patched up in support of our advocacy efforts of behalf of our game!

PPA PokerPAC Endorsements

Earlier this week, PokerPAC, PPA’s political action committee, endorsed candidates in 53 US House races and 2 US Senate races. With Election Day in just one week, we wish to let the poker community know who the champions of poker rights are and why they deserve the support of the poker community. If you did not receive an endorsement email, it is because we had no endorsements in any of the races in your district.

Please keep in mind that, when making endorsements, PokerPAC makes no considerations other than the stance the candidates take on our right to play poker. The big news this week is the release of the draft of the legislation that, if passed into law, will license and regulate online poker in the U.S. This bill, officially titled the “Internet Gambling Prohibition, Poker Consumer Protection, and Strengthening UIGEA Act of 2012″ but more often referred to as the “Reid/Kyl bill” after backers Sen. Harry Reid (D-NV) and Sen. Jon Kyl (R-AZ), will potentially see introduction during the lame duck session of Congress (the session immediately following the November elections). In addition to giving us licensed and regulated poker in the U.S., this bill provides for consumer protections, including mandated segregation of player funds, background checks of providers, and criminal penalties for cheaters. It also provides a real framework for the game. With a solid foundation upon which to build the game, rather than watching online poker degrade each year, we would once again watch our game grow and thrive year after year.

While the bill is largely in its final form, PPA is continuing to negotiate for further improvements. While no one party will get 100% of what they want in this bill, I believe the ultimate bill will meet the needs of the community. Polling on the Two Plus Two forums (here) shows the community strongly in favor of moving this bill forward.

If this bill does pass into law, states will have to opt-in to participate in this new poker market. PPA is prepared for this fight, but we cannot do it alone. I encourage you to keep an eye on the progress of this bill and to keep reaching out to your state representatives to ensure they know you want them to support your right to play!

Full Tilt Poker Remission Update

The PPA has been in recent communications with the Department of Justice to inquire on the status of player repayments of their Full Tilt Poker balances. We have been assured that the Department is working diligently on this matter. In the near future the PPA will be meeting with the DoJ to assess their progress and provide further input and assistance for a streamlined repayment process. Full restitution for the players remains a top priority for the PPA and we are doing all we can to ensure that all players will be treated equitably. We will share more information as it becomes available.

43% of male respondents to the PPA survey reported they were financially ahead (+) lifetime playing online poker while only 24% of women stated the same when paneled. 25% of respondents in both genders acknowledged they were behind (loss) playing online poker.

Last week, I asked you to send the all-new PPA fully editable prewritten letters to your elected representatives. I am pleased to share with you that this call for action was met with enthusiastic participation! I thank everyone who sent their letters out.

It is great that we are doing our part as poker players and enthusiasts to stand up for our rights. This week, I have an equally important follow-on request to ask of you.

Will you ask your friends and family to join you in sending the PPA letter to their lawmakers? If you encourage just one person to join this action – which will take them less than one minute – you will double your impact!

If the entire poker community gets one person each to help out, the entire effort will see a tremendous surge. With legislation pending on Capitol Hill, this is absolutely the time to flood Congress and statehouses across America with demands for legislation licensing online poker.

Federal legislation to license online poker continues to gain steam on Capitol Hill. There has been a lot of mainstream coverage of the issue and, as we all know, where there’s smoke, there’s fire! I am so proud of the poker community for coming together to push for our rights and to advocate for our game. Thank you all for standing strong in this tough battle for our rights!

Last week, I mentioned that many are lobbying for specific provisions in the bill and that some proposals are favorable to players and some are not. For an example of the battles on Capitol Hill, I encourage everyone to check out an article in The Hill on the tough lobbying from state lotteries (click here). These fights are day in and day out and PPA is there lobbying for our interests. As we know, many groups are lobbying for poker, but only PPA is lobbying for poker players!

One concern I mentioned last week was penalties on players on unlicensed sites. I have good news on that. PPA has reached out to the Senate staffers responsible for drafting the proposed bill. We have been assured that there are no criminal penalties for players in the proposal. The language on this issue in the summary of the legislation is directed solely at funds used on unlicensed sites. The language is there to establish legally that, going forward, under a licensed system players will not be able to seek repayment of money seized from such sites or their payment processors from the federal government. In other words, players will not be targets of enforcement of this bill, which is what we were seeking.

As the legislation continues toward finalization, be assured PPA will be there on Capitol Hill, standing strong to win the maximum in player-friendly provisions throughout the process!

Maryland Question 7

PPA has officially endorsed Question 7, a Maryland ballot initiative on which that state will vote this Election Day (Tuesday, November 6th). This ballot initiative will create new opportunities for all of us – state residents and non-residents alike — to play poker (and other table games) in new and existing Maryland casinos.

Question 7 does more than just authorize casino poker rooms. It will also create thousands of good paying jobs and raise millions in new revenues to support Maryland’s educational system – all without raising taxes.

Let’s all show support for Question 7 by visiting www.voteforseven.com, “Liking” their Facebook page, and following their Twitter page. You do not have to live in Maryland to support new poker venues!

Question 7 is an important issue. Please support Question 7 on November 6th!
