Clear and uncontested standing

    Hi Skallagrim, this is probably a dumb suggestion but I thought what the hell. If "every poker site that serves the US market has clear and uncontested standing to challenge the applicability to their business of not just the UIGEA, but all Federal Gambling law" then what about a new poker only site. Say set up a site that has not yet allowed US players or done anything the owner could go to jail for. Get others sites to donate funds to this site for legal fees and expenses. Have the site owner request the applicability to his business to allow US players to play for real money on his site. Once all is done then the owner can close down the "new" site. This way the questions get answered and donating sites are not hurt by a real new site or have to risk jail. Would this work in this form or something close to it?

    poker players alliance is just another organization who claims to be about poker but really is not. all they care about is selling their t-shirts and making money. it was a major coup to sign up former wsop champion russ hamilton. he is only the biggest online poker cheat in the history of online poker. 66 million dolars he cheated the players out of at ultimate bet. never prosecuted. was allowed to keep the money. what a joke. ppa accepts him in with open arms.

    stoner111, I can't find anything that confirms russ hamilton being accepted to the PPA with open arms. There is a lot of good people in the PPA who care greatly about poker and the rights of poker players. I trust TheEngineer and Skallagrim. I don't believe they would be involved in an organization that was just out to make money. It is not in their character.

    I am truly tempted to delete stoner111's post, but I am not going to right away. Thanks for your response, HoldemEagle. I am going to leave it a few days because, well, free speech is free speech. But 1) it does not belong in this forum and 2) its complete and total BS. The PPA strongly condemns the AP/UB scandals. The PPA supports clear legality of the online game precisely so future Russ Hamiltons can be more easily caught and more easily prosecuted. If Mr. Hamilton is even a member of the PPA (I truly don't know) he certainly has never had any role other than being listed a member. Pretty much anyone can be a member and the PPA does not engage in "purges."

    Now, on to your point HoldemEagle. Very creative idea! The only real problem I see with it is that to truly get to a point where there is standing, the potential plaintiff site is going to have to engage in spending a fair bit of money and effort. That is asking a lot of someone just to make a legal case. But it has been done by other folks in other causes.

    I am not sure it should be a PPA effort though. The PPA has resisted the idea of having sites and other poker related businesses as members. The sites and businesses, after all, have their own trade organizations that can represent them. The PPA is here to represent players; our relation to the sites is, at present, one of allies. That could change down the road once legal online poker is truly established.

    Still, I am going to pass this idea along to the site trade organizations. I can see a point one-day where circumstances are such that they may want to use it.

    Interesting exchange. Stoner is obviously a malcontent. Someone who lost money on AB/UP or some other site and is looking for an avenue to vent. Picking on the PPA is easy, since we don't exclude even our malcontents. The PPA, and by defination people like Skallagrim, are fighting for the rights of poker players everywhere in this country, not just online. I'm always interested in those with opposing views, but not in those whose only goal is to trash someone or some organization without ever having participated in the effort or the fight to make things right. That we tolerate even those who, like Stoner, only want to point fingers without the slightest evidence, speaks well for the organization, don't you think?
