Skill of the play over cards dealt.

    In a big multi-table tourney you find yourself on the money bubble in the BB with pocket queens. You have a big stack who is abusing the bubble go all in and you call instantly knowing your way ahead of his shoving range and you need a bigger stack to make a bid for the final table. The cards your dealt help you here.

    However the same QQ on a single table money bubble (3 pays and 4 left) might be folded. Say the blinds are 100/200 with a 50 chip ante, the cutoff has 225 chips and folds, the big stack on the button pushes, the small blind folds and your in the big blind with QQ and 2900 chips. Now the dealt cards don't matter and you fold even though your way ahead of the big stack's shoving range. Your decision is based on the short stack's chips, your chips and the size of the blinds.

    Is the single table hand what would be used in court for game of skill? Knowingly folding what is likely the best hand puts the skill of the play over cards dealt.

    This is indeed a good example of how "skill" concerns totally independent of the cards dealt can determine what a player chooses to do in a Hold 'em tournament.

    What for the next brief and I will try and use it for just that purpose!

    As to your legal question, I feel very confident that we do NOT have to worry about a "single hand" analysis being applied with respect to the legality of TOURNAMENT poker. Even our most highly politically motivated-against-us courts can't go that far and keep a straight face.
