I am a member of Full Tilt Poker and another site and have been playing for months.I tried to join ClubWPT.com today and it appears to be illegal in Georgia, is this possible? Can anyone shine some light on this for me? I dont get it. Thank You, hassle89

I have the same problem hassle, as it is also not allowed in my state of Maryland. I believe the reason why is because the concept used by ClubWPT (monthly subscription) removes it from the gambling arena and places it under the jurisdiction of the individual states' 'Sweepstakes Laws'. The legal minds at clubWPT have determined that there are certain states where the sweepstakes laws make their product illegal, or at least illegal for a resident of those particular states to participate.

Without too much detail (although I will provide more if you need it) ClubWPT and other similar sites rely on a "sweepstakes" model to ensure that there activities are legal. As has been said, by making participation in their tournaments "free" (you could aways send in that 3x5" card you know) they are not engaging in "gambling" - gambling requires that the participant "risk something of value."
But there are other laws besides gambling laws. Many states have laws regarding sweepstakes, as does the federal government, which regulates sweepstakes through the FTC. The FTC requires all companies providing sweepstakes to comply with all STATE rules regarding sweepstakes. Some states ban sweepstakes outright, others impose significant restrictions on them. This results in the list of states excluded from these sites. You can still play for fun in those states, but you can't win a prize because then you would be participating a sweepstakes that is not legal, for whatever reason, in the state from which you are playing.
