    Hello all,

    Just quick note to everyone in the Northern CO area, read and understand CO statute 18-10-102 and 18-10-103 these are the statutes that define gambling see link CO Statute

    As one of the 5 that are accused we are all fighting this through the courts. It seems to be leaning our way based on some other factors in the case that I cannot divulge publicly at this time. We are hoping for a dismissal before trial but we are prepared to go to trial(s) if need be.

    There are 5 separate cases pending and all are set for jury trials that should be financially prohibitive for the state based on the possible fines in the case. We are also hopeful simple economics in the case wins out.

    On Jan 22, 2009 the jury returned a not guilty of illegal gambling verdict in my case. The other 4 defendants case are still pending so stay tuned for updates, as soon as they are all settled we can divulge the details fully.

    On Jan 27, 2009 one of the other defendants was in court for a status hearing at that time the Deputy DA in the case would not dimsiss the case or drop the professional gambling charge as they had done in my case. He indicated he would have to talk with the DA about everything and hadn't had time at this point. All the other cases are at various stages of the court system, you can find the Greeley Tribune website to get all the details.

    The defense attorney in the case notified the prosecution that they intended to call DU professor Dr. Hanum as an expert, as I had done, and the DA was already begining his objections. It appears the expert testimony played a key part in my defense as I stated in the other thread. So we are all hopeful that the DA comes to his senses and drops all the other cases.

    I will be surprised if the case gets to the judge. You would think since the ruling in your case, they would drop all charges.. No, instead they want to look like an Ass a second time.. Amazing!
