I am planning on having a charity tournament for the American Diabetes Association here in a few weeks and was curious about the law. The way I read it is charities cannot host a tournament but what about someone on behalf of the charity? Is that legal? I will give no money out 100% of money collected will go to the ADA, but I will have prizes that have been donated from various organizations around town.

Georgia's charity gaming laws only allow raffles and bingo. Charity poker tournaments as traditionally run (X% of entry money goes to charity, Y% of entry money goes to prizes for participants) would be illegal under Georgia law. It seems to me from your description that what you are attempting to set up is a "free" poker tournament and to award the prizes as in a charity raffle. This could be OK. It probably requires that you make explicit to the entrants that their performance in the tournament will have no effect on whether they win or lose any particular prize. In other words, what you are really having is a charity raffle, and a free/no-prize tournament just happens to be taking place at the same time. To be certain this is OK, you may wish to ask a Lawyer in Georgia. The PPA can recommend one to you if you so choose (send an e-mail).
Also, there are other technical requirements for being a legal charitable event, be sure to meet all of those too (you can find them at the link above).
A quicker and cheaper way to be certain of your "tournament's" legality would be to contact you local sheriff's office and explain to them what you have planned and ask if they have any problem with it.
