   The key word in your question is "play." There is no crime in New York that would cover playing poker online.

   NY has plenty of anti-gambling statutes, and a bad definition of gambling for poker (is chance a "material element" of the game of poker?), but none of its criminal statutes criminalize the act of playing. All the criminal statutes are aimed at the operators and promoters of gambling, not the players.

   The same is true of any arguably applicable Federal Law, there is no crime committed by the players.

   A far more thorough discussion of these issues can be found in the "Ask Skallagrim" forum - and I will be moving this thread there after a few days.

   And speaking of the "Ask Skallagrim" forum, do you folks know that it was put there precisely so you could ask these kinds of questions to an attorney, an attorney who also happens to be the Litigation Support Director for this organization? Perhaps we should clarify that in the introduction to that forum? Feedback on this is welcome.
